Passport photos for petiton?

Hi all!

My fiance and I are just starting the whole K1 process, and beginning to gather information for me to send the petition to the California Service Center.

One thing about the passport photo that my fiance needs - the specifications says that the photo needs to be 2 x 2 inch. My fiance (who is in England) tells me that everywhere they get passport photos taken are much smaller than 2 x 2 and he has no idea where to get one that size...and he thinks they will reject it.

He did say the one place he knows of that takes that size passport photo is the US Embassy in London, but you cant get in without an appointment (he went to get a B2 visa to visit me....got denied...another story). London is a long ways away from him anyways.

What should he do?

Sidenote - he has been disqualified from the Visa Waiver Program, refused entry to the US, and denied a b2 visa to come visit....will this affect us getting approved for the K1? Also I have two misdemenors on my criminal record....it looks like for the petition etc they only look at background records for the foreign fiance...is this true?

I agree with payxibka. USCIS doesn't appear to be very ####### about the passport style photos. My fiancee gave me photos that were 4cm x 6cm, with a light blue background (as opposed to 2in x 2in with a white background). She also submitted the same photos at the consulate for her interview. She didn't have any problems.

Whether your fiancee's previous denials (VWP and B2 visa) will have any effect on the process depends on what he was denied for. If he was denied because they thought he had immigrant intent, and he couldn't provide evidence of sufficient ties to his home country, then it shouldn't be a problem. If he was denied because of some other material inadmissibility, then it could have an effect. For example, if he had a previous immigration violation in the US, then he might be denied the K1 visa at the interview, and you'd need to apply for a waiver. We need more info to give an opinion on this.

USCIS does perform a background check on the petitioner. If your convictions fall under either the IMBRA or Adam Walsh Act, then it will have an effect on your petition. Again, more info is needed.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Hi there!

I have recently submitted my K-1 so I am no veteran at this. However, while attaining an official passport photo is nice, its not required. A "passport style" photo is what they are asking for. You can take the picture yourself and size it yourself as long as it fits the specifications asked on the application and those required of USA passport photos.

Apr. 5, 2010 - NOA 2

Apr. 12, 2010 - NVC Received

Apr. 14, 2010 - Left NVC for Dominican Republic

Apr. 22, 2010 - Consulate Received!!

May 24, 2010 - Packet 4 Sent (Still haven't received it...)

June 29, 2010 - Packet 4 Received (Had to pick it up at the consulate)

July 9, 2010 - Interview Date...omg!!!!!

July 9, 2010 - Visa Approved!!! W00t, w00t!!!!!!

Oct. 1, 2010 - POE (very easy, no problems, and he even got approved to work!)

Oct. 20, 2010 - Married in Las Vegas baby!!!!

AOS

Dec. 3, 2010 - Sent AOS and EAD

Dec, 5, 2010 - I-485 and EAD received

Dec. 10, 2010 - Date of NOA 1

Dec. 11, 2010 - NOA 1 received in mail (they told us it would take week in the email =p)

Dec. 18, 2010 - Biometrics appointment notice received for January 12, 2010

Jan. 12, 2011 - Biometrics Appointment (Strange but fine)

Jan. 13, 2011 - Transfer to CSC NOA received (dated January 7, 2011)

Feb. 9, 2011 - Email notification of a Decision: AOS Approved!!!!

Feb. 11, 2011 - Email notification Green Card in mail

Feb. 17, 2011 - Green card received!!!! The card wasn't green =P

No my convictions were not under IMBRA or Adam Walsh. And my fiance's denial was based on them thinking he was coming over to immigrate...and obviously he is. So now since we are going through the immigration steps I would guess it wouldnt matter.
