Hi people.

My lawyer filed my I-130 for my husband. He is under removal prosses. I didn't know that if person under removal then I-130 should be filed with "Bona fide marriage extension" letter, that means that our merrige real. So officer denied I-130. I'm going to appeal it. I wont to know if somebody had such situation.

What do you think, if my lawyer did it wrong with sending not all papers, can appeal help. Or what it would be wright to do in this situation? Thank you.

Your profile states you are doing Removal of Conditions. Is your profile wrong? Why was an I-130 filed?

I filed for my husband I-130. he is in removal prosses. officer didn't allow us to the intervie. he told us my I-130 should be filed with "Bona fide marriage extension" letter. Because he is under removal. he denied my I-130 amd i wont to appel it. But i don't know if it's gonna work because it was my lawyer folt.

Need more info. What visa was your husband on? How long did he overstay? Did he EWI? Did you file the I485 as well? When did you file the I130 and when was it denied? Was he already in removal proceedings when it was filed or has he now been placed in removal proceedings?

no he didn't file any suportive papers. just I-130. now we going to Appeal officer decision. it cost $ 110. and present all papers and avidence. and bona fide merrige too. by the way should it be wrriten by hand? and can we still file motion to reopen? it cost $530. may be it's better just Appeal? we have still 2 weeks to do it. it was 10 days ago we got denial letter. thank you.
