Timeline

If using my wife's assets, should her assets be 5 times the poverty line or 125% of the poverty line?

Also, can we use my assets abroad (in Italy where we live now) to supplement that?

Any help?

This is what the official government website states

What Cash Value of Assets is Needed?

To be counted, the cash value of assets must equal five times the difference between the sponsor's income and 125 percent of the poverty line for the household size.

For example, a petitioner/sponsor with a household size of four and an income of $18,000 would need assets equal to five times the difference between his/her income and the income required for a family of four at the current federal poverty guidelines level. He/she would also need to show evidence of mortgages, liens, and liabilities against the assets.

The cash value of assets required is different for these sponsors:

Sponsors of immediate relative spouses and children of U.S. citizens must only show assets in the amount of three times the difference between the poverty guideline and actual household income.

Sponsors of foreign orphans who will acquire citizenship after admission to the United States need only prove assets in the amount of the difference between the poverty guideline and actual household income.

12/07/2009 - I-130 and supporting documents sent to USCIS office in Rome

12/16/2009 - USCIS office received the form

02/16/2010 - NOA1

02/22/2010 - I-130 Approved

05/27/2010 - DS-230 sent

07/19/2010 - Medical exam in Napoli

The Italian Consulate in Naples DOES NOT even consider assets in Italy... They want to see 3x the 125% in a US account in the US citizens name (@ $56,000)... This was a very specific requirement we were asked by the Naples consulate in November...

The Italian Consulate in Naples DOES NOT even consider assets in Italy... They want to see 3x the 125% in a US account in the US citizens name (@ $56,000)... This was a very specific requirement we were asked by the Naples consulate in November...

We have very significant investments in Italy but they would not even consider them... the CO asked for us to produce a bank statement showing 56k in an account in my name in the USA... Once she saw that, visa was issued... The rest was a piece of cake in Naples...

The I-864 Instructions say:

So, sounds like it's 3x if you're sponsoring your spouse or child, or 5x if you're a joint sponsor and supporting a friend, cousin, etc.

I'm not sure if different consulates follow different rules-- could you call your local embassy and confirm?

I cannot at the moment since I am abroad for work... but some people says 5x some others 3x... I think the difference relies in what you just said!

I cannot at the moment since I am abroad for work... but some people says 5x some others 3x... I think the difference relies in what you just said!

The "official" guideline document says 3x, if it's for a spouse, so since that's your situation, I'd say 3x. :)
