hi everyone.. I need your help. I already have my K1 visa which was approved last December. In the course of 3 months, a lot of things happened, my fiance and I mutually decided not to pursue getting married soon due to the many personal matters involved. We agreed of delaying the plans since we both realized that we might have just been deceived by our emotions in getting married too soon. We love each other, yes, but there are areas we still need to work on and for us to prepare ourselves more for a better partnership in time..

1. I just want to ask what shall I do with my visa? leave it like that and let it expire? or shall I inform the embassy regarding the changes of our plans?

By the way I am planning to get a tourist visa since I already have my ticket and a two more round trip passes to US issued by my employer (Philippine Airlines). Will there be any conflict if I apply a tourist visa now since my K1 isn't expired yet?

I need your help.. sad.gif it was never easy to decide not to pursue but we really have to.. I just praise God we're still good and ok. Appreciate your future responses! God bless

sorry to hear this... but of course we have our own reasons why?... uhmmm but i think u need to cancel first ur k1 before u apply for a tourist visa... and best of luck to u both on ur plans...

oooh sad to hear that ha...as i know in 90 days given to you to marry your fiance..you need to get back where you come from if theres no marriage been happened..and the petition you applied is no longer have sense na..you need to apply for another one, if you both want again...so i think you need to finish the time given to you..before you apply for tourist visa..they will not allow you to have 2 diffrent visa process in same time you have K1...you know we been through with all personal matters that affects our relationship..but we ddnt give up..because we both know and feel..we love eachother deeply...so we talk..we look forward of moving on in all that..and decide to be fresh as new starting relationship again..till we have it and continue to plan for our future embracing life together..even we been broke by past..!!live it all behind..forget it..and live on whats best.. you both know will help in your relationship to grow more and more..hope soon you both realize it..and all the effort you both given in your relationship have worth...dont loose it..hold tight to eachother..have faith..great love live..hugz..and godbless..pray and be strong..

I would contact the US Embassy that issued the visa because it is good for up to 12 months from the date of issuance and keeping it valid while you try to obtain a tourist visa might cause a delay or denial.

I'm wondering though about your chances of being approved a tourist visa given that you applied for a K-1? The U.S. Embassy is notorious for denying tourist visas to young, single women in general.

I don't really see you being able to get a tourist visa, if you withdrawl or allow your K-1 visa run it's course with out being used. This will not look favorable for your tourist visa, or the future petition(s) The petitioner as likely the beneficiary, bears a heavy burden to establish the bona fides of the relationship in the case of a prior visa withdrawal.

My wife was denied a tourist visa, and that is what prompted us to just go ahead and get married and get her here and all the mess over with. But it wasnt all good...she left me twice, and thought I lost her for sure the second time. She had conflicting things in her life she had to deal with first. But she is here now, and all is good, and she closed doors, and we have a baby that is 17 weeks on the way. I cant see how a single woman could get a tourist visa, as picky as the embassy is, in your situation. But maybe you are more able to get that approved...dont know.

Why not follow thorugh with the K1 visa, and see what happens once you are here? At least you can use that time to work through whatever issues are at hand, then reapply later.

I really respect your decisions to wait though. That is a tough choice to make. I see a lot of stength and character in both of you and I admire you both. Make sure to pray about it a lot.... Trust in the Lord with all your heart, and lean not on your own understanding. In all your ways acknowledge Him, and he will make your paths straight.

Sometimes things are better ironed out in person. Since you already have the visa and the ticket, why not come here and make use of the 90 day period to really get to know each other " in person"...if things still dont work out within that period, the go back to the Philippines.

It is still worth a try.

My husband says if you're not sure stay home. Give the visa back to the embassy. But I say use the k-1 visa. It's hard to apply for a tourist visa at the embassy. Why not use the one you have right now?

Your giving up the K1 visa and taking the risk applying for B1/B2 is a good sign that you have NO INTENTION of circumventing U.S. immigration laws, which is what the US Embassy is watching out for. You are giving up a K1 visa that almost guarantees you U.S. entry and yet you are more than willing to let go of it. The US Embassy will see that as a plus point when you apply for a B1/B2 visa.

Do you still work for PAL? And how many years? The fact that you are working for Philippine Airlines that provides you with free tickets to travel anywhere in the world is another plus factor for you. Your employment shows strong ties to the Philippines.

I don’t agree that withdrawing your K1 visa would not be viewed favorably by the US Embassy. On the contrary, K1 withdrawal and/or B1-B2 application/denial has no effect on any future petitions. You and your fiancé realized that it may be too soon to marry. The USCIS, NVC and the US Embassy will not punish you for having arrived at that realization. I’ve had two K1 petitions applied for me (by the same person) and I've had no problems with the visa process whatsoever. You just need to declare the prior petition in the forms and write a waiver.

I do agree with jom's and rocky n bulwinkle's suggestion. Why not come here and if things still don't work out, you can go home. No use paying another $131 when you already have a visa.

I say that you have a good chance obtaining a tourist visa but then again, it all depends on the consul interviewing you.

She might just want to see US of A, we have great places here to check out!

I can understand her concern not to enter US using K1 visa, since they have no intention of getting married yet. I think, 90 days is given so you can prepare for the wedding and what not. But not to figure out if the relationship will work.

If she will be approved for B1/B2, that is a good chance for them to figure out things about their relationship without the pressure of getting married. At least, longer than 90 days.

I do agree with Pinay Wife, notify the USEM if you're not using your K1. Pursuing your tourist visa, for me is not a bad idea, if you are still employed with PAL and got some cash in your bank, you might have strong grounds to get approved!

Lots of good advises here.

My .02 is you should cancel your K1. K1 is intended for fiances that will get married in 90 days. If you do not intend to get married, then you are not a "fiance". It might also be considered as fraud.
