They received payment on 10-09 and 11-09 transferred it to CSC. His Biometrics was 12-09 and on 2-10 they transferred it again to N.B.C. in Lee's Sumit, Mo. We live in Florida and I don't understand why it's been transferred twice. Has anyone had this happen to them before? On A.O.S. forum they seem to think he's getting an interview, but we don't live anywhere near Mo. Any idea guys why it's been moved twice like this? They said, Mo was the Jurisdiction, but i'd think there'd be one closer to us than Mo. Now I have to wait 180 days before I can call them with questions.

It can/does happen - very likely your case was sent back to your local office where an interview will likely be scheduled.

Nobody would know yer in Florida - you've not put it in anywhere on yer profile (I know, I looked prior to answering yer question). Most assumed (myself included) that something was to be done at local office - since NORMALLY if its returned FROM CSC, and you get a notice about it - well, sorry - yer up for an interview at the local office. Everyone assumed yer local office is in MO, you never menioned squat about the NBC in yer other post.

NBC is used for 2 reasons -

1. case review and

2. case storage.

IMO, it being at NBC at this stage - is up for case review.

Perhaps if others 'knew more specifics' about yer casefile, they'd give 'more focused answers'.

Maybe.

The office in Lee's Summit is the National Benefits Center, but I agree it sounds like your case is headed to your local office for an interview. We had one for AOS and for Removing Conditions ....:P But it says in your signature that you already had an interview for AOS? is that true?

if so I would guess that it probably means your case has been approved and just transferred to storage but frankly if it were me I would call he USCIS line and ask them to look it up and clarify the status.

** No, he had his Biometrics not AOS interview in December, 09. I just corrected this in my signature. There were no problems at the Bio and he had his EAC within a week after Biometrics.

It sounds like your file is working through the system. Work load shifts among the centers to try and keep things moving along. The trip to NBC is just a part of the journey.

NBC is what is behind the Chicago Lockbox address. That update may just be a reflection of the EAD processing.

The online updates often do not correlate to what's happening with a file. For example my wife's Removal of Conditions was not updated from Biomentrics being done until after she received the new Green Card in the mail.

As already pointed out, the national benefits center is in Lee's Summit. The EAD and the AP documents are adjudicated only by the NBC, so all I-765 and I-131 forms are sent there. For AOS filers, they cannot be approved if the AOS is not filed properly, they are usually sent together with the I-485 to check for completeness. My guess would be that they'll recheck the file for completeness, send an RFE if they find that something is missing, or simply approve the EAD/AP if the file is complete. In most cases, once the work permit and the advance parole is approved, the I-485 is forwarded to a local office or to California.

If you read through the AOS forum signatures, you will notice that all EAD and AP documents are mailed from Lee's Summit, and almost all RFE's that are mailed prior to the EAD approval are mailed from Lee's Summit (also, almost all RFE responses have to be sent there). Sometimes the California Service Center or the local office sends an RFE, but in 90% of AOS cases, the RFE is sent from the NBC because that is probably the first time they check the entire file and supporting documents before it's sent to a local office or to the CSC.

All of the correspondence I got from USCIS was either from the NBC or from my local office. I have a friend who lives in San Francisco who adjusted his status about 3 months before I did, and he also got his first NOAs from NBC.

They also frequently shift cases from center to center if there is a significant backlog at one location, even after they approve the EAD/ AP. With the bad weather affecting Vermont, and the CSC processing additional Haitian petitions, there might be backlogs at both centers.
