This forum is a godsend. I used to think I was fairly smart - until we got involved with all this. It's amazingly complex. :blink:

Incidentally, when we file this, should I attach a copy of the NOA from the I-130?

You definitely want to attach it - without it you don't have a basis to AOS and you don't want to give USCIS any reason to deny your petition for AOS.

Sorry to blow this up but I just want to make sure I'm doing this correctly.

When we file the I-485 should I include documents that show we have a bonafide marriage? For example, our apartment lease that has both our names on it, photographs of the wedding, emails dating back 3 years, photos of all our visits to one another, and letters of support from people who know us and know us to be a genuine couple. Should we send these with the I-485 or wait and take that stuff to the interview, assuming we get one?

Also, you said we should attach the NOA for the I-130...will copies suffice or should we send the original? Thanks.

yes, generally speaking regular photocopies are sufficient

Provide all the evidentiary documents as required for the filing (even if the I-130 has them as well). Unless an original is specifically asked for, regular photocopies

I'm sorry this sounds so dense, but what I really want to know is - aside from our marriage certificates and the other stuff they ask for like the affidavit of support - should I send proof of our relationship (photos etc.), even though they haven't asked for it?

If they don't ask for it it is not needed... all that stuff is in the I-130 or will be presented at an interview

You have to apply for:

1) I-485 and I-130 for both of you.

For the I-485, you just select "An Immigrant Petition giving me an immediately available immigrant Visa number that has been approved" which is selection "A" on the form.

At least that's what I selected when I applied (came in as a tourist, married and adjusted) and everything went fine.

07/17/09 - Biometrics Completed [ Completed in 17 Days ]

08/20/09 - Interview notice arrived dated 08/18/09 - Sept 24th/09

08/21/09 - Got EAD Card in the mail!! :D

09/24/09 - Interview Date: 9:00am - APPROVED

10/03/09 -Received GC!!!!!

Total Days from NOA1 to Approval : 86 Days

04/01/11 - Preparing for ROC currently

06/27/11 - ROC Mailed!

07/02/11 - NOA1 Arrived [dated 06/30/11]

07/13/11 - Biometrics letter arrived [08/01/11]

10/31/11 - Final Approval!

11/04/11 - Received new card today.

Total Days from NOA1 to Approval: 125 Days

Next Step will be citizenship in June 2012!

Thank you, that's exactly what I needed to hear! We already filed and got the NOA for the I-130, and we're filing the I-485's in the morning. I've been going through and making printed copies of emails, photos etc that they might need in the near future and I am keeping my fingers crossed. Glad we had some money saved up though, $2020 for filing 2 forms is insane!

Make sure you read through the guide before you send everything-it's really helpful. We were VWP adjusters, and our understanding of the instructions was that we DID need to send some proof of bonafide marriage when we filed the I485. Feel free to PM me if you want and I will tell you all the things we did.
