Filing for AOS while unemployed?

I fiancee arrived a month ago on a K1 visa. Unfortunately, I lost my job in December and still haven't been able to find another one yet. I know that the Affidavit of Support is required for the AOS application package, so I'm not sure what to do here. If I don't have a job at the time of applying, will it be rejected? Right now we're getting by on unemployment and savings. I'm trying really hard to find another job, but there's not a lot out there right now in my area which is IT. I may have to take a contract position if I can't find something permanent soon. How do they look at contract jobs on these things?

They will want to see that you have sustainable earnings so I'm not sure how a contract position will be looked at because it would have an end date. You may have to get a co-sponsor for when you file to meet the requirements.

Oh really? So, I guess if I can't find a permanent job in the next 2 months we're pretty much boned. There's just so few jobs out there right now and so many qualified people looking for work. The pressure is getting intense.

Can you not find a co-sponsor? If not I wouldnt panic, you have to get married within the 90 days, which you did, but if you can't apply for AOS right away its not necessarily the end of the world. She will be out of status but as long as she doesn't do anything silly until you can apply for the AOS it shouldnt be too bad. They tend to forgive the time out of status for AOS due to things like this. I wish you the best on your job search!

I doubt I'll be able to find a co-sponsor. I was under the impression that you had to file for the AOS before the 90 days were up on the K1 Visa. Is there some kind of grace period after getting married?

Yeah theres no hard like you have to do it by X date, but you will want to get it in asap when you can. As long as you have gotten married in the 90 days you should be ok, Ive seen some threads in here from people who have been married for 2 years and are just doing the adjustment now. Sometimes life hits you out of the blue.
