Thanks Sachinky! I called NVC (they picked up on first ring  ) and was told yes I can submit separately. But attorney said they are not happy when they receive packets separately. Well anyways, going to go with what you are saying & NVC.

Guess they will be really unhappy with me  I sent 3 different ones...one I had to send separately because it was my expedite request. I figured they had different ATTN lines..send them separately even though I have read you can send them together. We will see if this causes any problems...dont think it will as I know sometimes it takes awhile to get the IV bill and people send off the AOS package right after they get the coversheet.

I am just waiting for the AVR to change from they will send me a package in the next couple of weeks.

Timeline

Just called attorney back & let them know I will be coming in today to complete the AOS package & was told its fine. But was told it can delay the process by sending the packets separately (from DS230) and they don't want to be be blamed for it in the future. I am still going to send it off but their wording made me worried. What if it is true?

It's not worth the hassle to go through them....I got my case expedited through the USCIS and approved in 53 days with an RFE and sending the evidence from Kuwait. I think you have to be over "normal" processing times. I will just wait and see what the NVC says. They just received my packages yesterday...so hopefully a case complete within the next week or 2.

I see. Well good luck with that!!!

Well, since your AOS bill cleared and lord knows when the IV bill will clear, you might as well, send it in. If nothing, it'll give them 2 extra days with the AOS packet.

I agree with you since with the way things are going with payments. But I just don't get why attorney would tell me to do it the other way (yes I know they deal with cases like this all the time).

And all I want is not to be lost & confused :crying: Maybe some smooth jazz will help  On Fridays they have where you can win a vacation somewhere. Ahhh how nice would that be. After all this, hubby & I need a much needed vacation.

In 2008 I went to Puerto Plata in Dominican Republic (for 2wks) & loved. Are you around there somewhere?

I don't see how it could possibly delay a case if packages are sent separately. That's the most common way to do things. Some people do choose to send both their packages together, if their bills clear close to one another.

How is your AOS bill cleared and not your IV bill. Looks like you paid them both on the same day.

I'm beginning to think that if you can, you should send both the AOS and the DS230 together. Reason is, that I got a RFE (CHECKLIST) from the NVC "asking" for the DS230. I sent the AOS in first, and the DS230 a week later and after they reviewed the AOS, they mark it as missing info when the DS230 isnt received and/or reviewed yet. If you can send it all at once! I say do it!

I to don't get why it would delay. But yes I paid them within couple min of each other & have no idea why one cleared & the other is still in process since the money came out of my account all ready.

What atsleumas is mentioning is a FALSE RFE--where they ask you for something that has either not been sent yet or it has and it's languishing in the mail room. Most common is when the DS230 is sent before the AOS package.

ATS--Think positive! No RFEs!

I'm oscillating between hopefulness and despair. On some level, I DO think we will make the April interviews (mostly because the rest of the folks with case completes have already been assigned dates over the last 7 days and someone will have to get dates next week--who says it can't be us?) but I don't wanna be too excited as I can't deal with another heartbreak. So I'm mentally trying to prepare for a May interview/reunion.

Me too. My only solice in a May interview is at least the weather will be a BIT better for my poor caribe husband who will freeze once he steps off the plane in Colorado. Our first year anniversary is May 28. I sure hope our interview is before that, but not after! I dreamt of us finally being together before we hit the one year mark.

But to have an April interview would be so wonderful. I think you and SJ are in a good place for a late April interview Sach.

On travel.state.gov site this is what it says;

If you ARE working with an attorney, the NVC will take the following steps:

Assigns a case number to the petition.

Send the Affidavit of Support processing fee bill and the immigrant visa fee bill to the attorney.

After the Affidavit of Support processing fee is paid, the NVC will send the Affidavit of Support Process and the Applicant Document Process instructions to the attorney.

After the Affidavit of Support and Applicant documents are submitted to the NVC, the NVC will review the information submitted for technical correctness and completeness.

After reviewing the submitted documentation, and the file is complete with all the required documents, the NVC will send the petition to the embassy or consulate where the applicant will apply for a visa when the case file is complete. For certain embassies/consulates, the NVC will schedule the applicant's interview. Approximately one month before the applicant's scheduled interview appointment with a consular officer, all interested parties (applicant, petitioner, and attorney) will receive an appointment letter containing the date and time of the applicant's visa interview along with instructions for obtaining a medical examination.

So then maybe I do need to submit them together?
