My husband recived the Signed Statment that is "Required" for the interview today and he went with his friend to go send it to the embassy cuz my husband cannot go back threw the boarder again he needs a pass. But anyways the boarder was closed till monday. but it was realy dangeruos there today there were lot of Arabic protesters there cuz of the problems there having the

Jews Vs The Arabs and when my husband and his friend whent to see if it was open or not the Jews started Shooting into the crowd of people that my husband and his friend were in. Thank God he is ok. I Told him on Monday just let his friend go alone cuz he has an american Passport and will have no trouble. Ugh i hope there give him his visa quickly so he can come here with me things are getting crazy over there. :(

Looks like I got the false RFE, which means they have accepted the AOS package (right? - AVS says they are missing documents, the word 'financial' wasn't in the message). We haven't sent the DS-230 in, still waiting on the corrected police certificates. We should get those next Thursday, then send the DS-230 so I can get on Sachi's list!

Thank godness, it is a false RFE. I think it means they have accepted your AOS bundle. Anyway, do not worry, be happy! :)

I am able to get my Police certificate next Tuesday. NVC Hurry! hurry! then we can get April interviews :dance:

Ok now im a little puzzled.I did my taxes on Friday and i told the Rep that i was sponsoring for my hubby.I asked him if i should file "married filing separate" and he told me i have to file single since my hubby is not in the country as yet and that when my hubby comes i will have to come and do an ammendment..Was that the wrong way..Im lost.,... :help:

In order to be included on your tax forms, your spouse needs either a SSN or an ITIN. ITIN is an Individual Taxpayer Identification Number. The only way to use one of those these days is to fill out a W-7 Irs form and mail it along with your tax return. There's no other way to obtain one of these numbers (that i know of, for filing taxes). You have to fill that form out then MAIL your taxes with that attached. I was hoping this whole thing would go faster a few months ago and that my wife would be here before the 15th but that's not happening..LOL I'll print one out this week I think and get that started.

Yah, People told him it would be quicker if he sent it VIA Aramex like the CO Told him, so he is going to send it Tommarow via Aramex and they will have it on Monday so i hope my wendsay or thursday they will call him to send his Passport. Its getting scary over there i want him to get here ASAP before God Forbid anything Happens over there.

I believe you can file W7 to get an ITIN#. Once you have that you can file a joint return.

I now understand. I wonder if my husband needs to fill the W-7 and mail to the IRS address in Texas while I write in process when filing. These looks kinda confusing for me. Meanwhile if yes, do you know if he can sign and scan the W-7 or he needs to mail the form signed and filled.

Hmm I have no idea, sorry... all this taxes stuff seems so confusing to me. I think our friend Kevin(Kevin-n-Merlaine)is filling with his wife and using the W7. Wait till he logs in and hopefully he'll be able to help you ;)

You can find the W-7 form online. Just print one off, fill it out and submit it with your tax forms. Only bad thing is you have to mail your taxes with the W-7 attached. There's no way to efile using this form :( It's the only way you can file and include your spouse without a SSN though.

RE: Filing Jointly with a Spouse Outside of the US

Tharnsur is correct that you need to file a W-7 to get an ITIN (Individual Taxpayer Identification Number) for your spouse. Your return will not be able to be e-filed. You will need to print it out and mail it to the IRS along with the W-7 and supporting documents (passport, birth certificate, etc). Read the instructions for the W-7 as to exactly which documents are needed.

Alternately, you can file a request for an extension. Write a letter explaining that you are currently involved in visa proceedings for your foreign spouse and are reasonably expecting an interview date in Such-And-Such Month with your spouse arriving in the US in This-Other-Month and that once your spouse's SSN has arrived (because you've already applied for it by checking the appropriate boxes on the DS-230) you will file your 2009 return. You may or may not be granted an extension. Either way, you won't know until you request it.

A third route. If you have qualifying dependents and meet other requirements, you are able to file as Head of Household. For HOH status ONLY, you are married but considered single if your spouse has not lived with you for the last 6 months of 2009. That means not living with you for even a single day after June 30, 2009. If you don't have qualifying dependents or do not meet the other requirements for HOH, then you CANNOT file using this status. To do so is illegal and carries severe penalties.

Note: If your foreign spouse has previously obtained a ITIN or SSN, then use that number. It has not changed. The ITIN will be replaced with the SSN once they arrive in the US, but until then the ITIN is still valid. The SSN will be valid forever.

What we did: I have a son from my previous marriage. I met the other requirements and filed as HOH. We may or may not amend the status to Married Filing Jointly once Husby gets here.

For more information, check out IRS Publication 17 (for answers to a ton of questions on filing taxes), Publication 519 (specific information regarding taxes and aliens), and Publication 901 (for information on tax treaties.... because your spouse probably has foreign income that needs to be reported if you're filing jointly).

Please PLEASE read Pub 519. There are certain cases in which you do not have to claim your foreign spouse or their income. You can claim them, and by doing so are voluntarily electing to have your spouse be treated as a Resident Alien although they are still Non-Resident Aliens. You may, however, still be able to file as Single. Check the Pubs and check with your local IRS office. They're here to help. :lol: No... really.... they are.
