We're planning on having an updated I-864 for the interview.

I just read that they're not calculated until late fall/winter so you should be fine :) Even if it changed, the diffference between 2008 and 2009 for a single person in the lower 48 states was only about a 100-125 dollar increase. Even as bad as they're jerking you around, I'm SURE you'll get an interview before October!!! Hang in there sachi, bout done now :)

Sachi,

I received the RFE email and after the J1 explanation they stated about financial evidence. The operator said it is only a warning. So do you think we should be fine taking the joint sponsor papers to the interview only? I' worried they won't give me a case complete waiting to see if I'll send the co-sponsor forms. What do you think?

FINANCIAL EVIDENCE:

The NVC has received the information you have submitted in reference to

the Affidavit of Support. Please be advised that you, as the Petitioner, do

not appear to meet the minimum income requirement according to the

current poverty guidelines to sponsor the intending immigrant(s) for this

petition. The consular officer will make a decision regarding this

requirement at the time of your interview. In order to avoid delays, you

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

intending immigrants. To view the current poverty guidelines, visit

http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending

immigrants, please note that you the sponsor may not use Form I-864EZ

and will also need to submit Form I-864.

I think we are ok according to the bold sentences right?

mrsWife--I think you should be okay for now but DEFINITELY have those for the interview.

From what I understand--NVC passes the case along to the consulate with notes on it for the CO to review. So this will most likely be asked for.

Gpmaan2--No, it's not required but good to have a copy of nonetheless.

We plan on making a new I-864 based on my husband's current employment which puts him over the guidelines and having that ready for the interview. Maybe we should've waited to send in the I-864 but I didn't want to waste time so we used my cousin as a joint sponsor for the NVC stage.

This would depend on your embassy. I'm sure you can hand them in on interview day. Or they will give you an AP slip with the documents marked and you have to submit them separately.

For example, for Indian beneficiaries, we have to submit everything to VFS (visa foreign services) 10 days prior to the interview. The CO thus has time to review everything before the interview actually takes place. I plan on submitting as much stuff as I can. If anything else is requested, it has to be submitted through VFS, not directly to the CO at the time of the interview.

Really? I didn't know that. So much easier huh?

From what I've seen in Brazil they give everything at the interview.

I talked to a lady online who had a CR1 interview last week in Rio and she didn't have the W2/returns for 2009 and they gave her a green slip and kept her passport. So as soon as she submits the papers they will send her visa. (she have also lived in the USA illegally for 8yrs, but she was under age, and the consul didn't even ask her about it, funny huh?)

Anyway, hope they approve me right away, since I'll have the papers ready to hand to them.

About your interview package. Everything looks awesome! I'll try to organize mine as well and them I'll post it in here.

sachinky-once you send all the documents with your ds 230 to nvc ?do they also want the beneficiary to deposit same documents or more to near vfs centre. i thought that this process applies to k1 or k3 visa applicants?
