I am applying for my minor child. The mother of the child is not immigrating as she has business in India.

Do I require any letter from my wife ( the mother of the child) allowing the child to move to usa.

If yes at what stage will that be required NVC OR EMBASSY INTERVIEW

Raj--Yes, the mother of your child MUST write a strongly worded letter of consent agreeing to the child's permanent relocation to the United States.

Someone else will be able to tell you if it is required for the NVC or the Embassy. I think it's for the interview.

You will need a letter stating she agrees to the move and that you share custody unless you have full custody then you need the court paper..

Custody paper or a letter is needed at NVC stage, a letter stating the child can move will be needed at the interview.

In my case I have Court documents for both custody and a court order to move my son.

Hope this helps at least a tad

well I have sent to my husband the statement letter for my RFE..everytime I see that I dont have the 2 years rule my head gets full of blood..really what a stupid RFE..thanks to Darnell and Sachi to help me write the statement..

Keep an eye on yer email - NVC EP cases are closed 'fast' and that appointment date is 'set fast' also.

If you're 'current' on sending in those emails to NVC -

I'll forecast a case complete on Sunday, and appointment date set no later than Thursday.

oh noooooooo!!! hopefully it's false! !!!

so i just called the AVR and it says "reviewed your packet and found information missing or incomplete." could be a false RFE right?? because we sent our ds-230 so much later and it hasn't been entered?

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Actually we are not divorced. the children are relocating but the mother will relocate maybe two/three years down the line since she has business to take care of in India.

So the courts don't come in. Everything is happening with mutual consent. I hope a notarized consent letter from mother will suffice. But do i send it with ds-230 or keep it for the embassy interview

GUZ is a painful consulate - you need to submit 3 years o tax / financial info.
