No, you are not allowed to AOS from a B1/ B2 to use this visa with a plan on immigrating and filing AOS is visa fraud and can result in a lifetime ban, don't risk it!

Since you say "we are planning". is your US citizen husband currently with you? If he has been living abroad with you legally for at least 6 months, he can file DCF (direct consular filing) for your spousal visa, which means everything gets handled by the embassy and is very fast (see my timeline, though it's a different country).

YOU CAN APPLY FOR AOS WHILE YOU HAVE A B1/B2 VISA. THE GOVERNMENT DOES NOT CARE AS LONG AS YOU DID ENTER THE COUNTRY ILLEGAL LIKE WITH NOT PASSPORT STAMPED. YOU WILL BE FINE FILE THE AOS IT WENT THROUGH FOR US IN 60-91 DAYS. APPROVED WITH INTERVIEW SO THOSE WHO SAY YOU CAN'T DO IT IS JEALOUS!

Read what I wrote. You can do AOS, BUT not with prior immigrant intent, as then it is illegal (and against VJ TOS to recommend doing so). Your second sentence makes no sense to me, did you forget a "not" ?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No-one said it wasn't possible, they said to do so with INTENT is fraud. As the OP has clearly stated their intent it is illegal for them to follow this path.

The can of course still TRY, but if caught face a lifetime ban. If AOS is denied they have no means of appeal and the immigrant will be asked to leave. It is approved often but who wants to be in the small percentage of people who are denied and find themselves in a lot of trouble?

I also agree with the PP when it looks like you forgot the word "not" in the sentence "you did enter the country illegal". I'm also interested as to why you wrote that yours went through in 60-91 days. Why a range of numbers? Do you just not remember or are you saying it's not your situation but an "average"?

As for your last sentence, few are "jealous" more people are annoyed that so many people are blatantly ignoring the immigration rules for the "proper" way to do it. It's like cheating on a test, sure you might pass the class but you are running a great risk and it's unfair to those that actually studied and did it the right way. You're encouraging people to find a cheap and easy way out and glamourising it, and not explaining the risks involved.

Like we said it's possible, but the risks far out-way the benefits.

As a side note, please locate your caps lock key and turn it off while typing. Leaving it on is a sign of "yelling" and most people will ignore your posts because of the blatant rudeness.

OP: You cannot intentionally use a non-immigrant visa entry to circumvent US immigration law.

every immigrant should be aware that their current status, conditional, removed conditions, or even citizenship can be removed from them by USCIS at any time for a variety of reasons. misrepresentation in filing forms is one of the reasons. doesn't matter if you've had citizenship for 20 years, it would be fruit of the poisoned tree, so revokable.

do the right thing. find a legal way to work thru your issues.

i know this is adead thread, but our newest resident uninformed loudmouth has revived it from the dead with commentary that requires refutation, in the interest of future readers.
