Missed interview for removal of conditional residency

Timeline

Filed the I751 back in Sept. Paid the $495. Received the notice for biometrics and completed that in Nov. Checked the case status online every week from Dec until now and the status is 'under review'. Just received a letter stating that our petition was denied because of failure to appear at the interview on Feb 2. We never received notice of the interview and the case status online is still 'under review'. The letter goes on to say that my wife has 30 days to leave the country. What do we do?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We haven't moved. One thing, is that we were out of the country from mid December through mid January and we had our mail held at the post office. I would assume that given a Feb 2 appointment, that the letter would have arrived while we were gone. Is it possible that the post office would have returned it for some reason? I'll call for the Infopass appointment today! Thanks!

I scheduled the Infopass appointment online. Scheduled for March 1st - the first available date. Does anyone recommend that we hire an immigration attorney? We are quite scared of this cirumstance as the letter states that the burden of proof on why the appointment was missed is on us.

You can try a walk-in infopass. Some not very busy offices have an appointment koisk at entry. I have seen people do an infopass without advance bookings. Also in parallel with the infopass, write to your local district office director about the problem, explain why youll missed the interview and attach all the proof. Ask him to reconsider or reopen your file.

If you cannot do this by yourself hire a lawyer.

Do this ASAP now. Time is not your friend.

You should also consider getting your congressperson's/senator's office involved. They can contact USCIS on your behalf and get results.

I would suggest if you do not get an Infopass appointment sooner , write a letter today and send it overnite to the service center , responding that you never received the Interview lettter along with a print out of the online status , tell them you would be happy to attend an interview whenever needed, make sure you and your wife both sign the letter , provide all the case details , include proof of your recent travel together , send then current bank statements , utility statements etc

make sure you mention the A number and the receipt number of your spouse's 751 case , also contact the congressman of your area

I'm sorry to hear this has happened. Don't panic. Take a look at my signature. We received the Intent to Remove letter. Infopass was very helpful by letting us know that they received our petition, but not our fee. We also involved our Congressman and eventually things worked out. You are making the right move by taking action immediately. Good luck. Let us know what happens.
