Please I need someone to answer this question.

I filed I 129 for my fiancee withouth including her 10 year old son on it.She plans on including his name on ythe form she is taking with her to the embassy,will this be grounds for denial?

No but it's not a good sign. The petition asked you to list all the beneficiary's children and you didn't. What other errors did you make? What else about your case is short of truthful? You're going through THE highest fraud Consulate in the world.

No but it's not a good sign. The petition asked you to list all the beneficiary's children and you didn't. What other errors did you make? What else about your case is short of truthful? You're going through THE highest fraud Consulate in the world.

I didn't name the child because I dont want him to come to the U.S.I dont want him or his dad in my life.

By the way she is only listing the child because she wants to be honest,the childs dad is not letting him travel to the U.S.

So it is no and no on following and accompanying her.

This does not seem to be off to an auspicious beginning. You and your fiancee do not seem to even see eye to eye on this issue.

In any event, you should have listed the child on the I-129F whether the child was following the fiancee or not. You made an error. It is not likely the I-129F will be denied as the USCIS will not know about the child. However you have damaged the likelihood for success at the Embassy by improperly filing the I-129F with all the children of the beneficiary listed.

No one can say what the Embassy will decide when your fiancee comes forward with the truth about her child(ren).

Would this mean filing all over or is there an amendment to this situation?The embassy already knows she has a child because she applied for a visitors visa some years ago and listed the child.

I petitioned for my pinay wife and her 10 year old at the same time. They're here and Green Card in hand. However, if there are no plans to bring the child I don't know why you would include them on your petition if you're not planning on petitioning them - seems to make logical sense. On the other hand you're propbably supposed to mention she has a child that will remain with the biological father? She will be appearing at the interview by herself and the VISA and petition are only for her. You could try to do what I did when I forgot to include my wife's anulled marriage on the I-129.

According to the instructions on the Embassy web site you can write an explanation of the error, have it notarized, and send it to your finance. If the Embassy brings it up at the interview she can show them the letter. The important thing is that the Embasssy is aware that you are aware and approve any changes made to the I-129.

So, then what else did you not tell the truth about? The question is rhetorical but this is what the Consular officer is likely to think. The petition asks a question to be answered by the US Citizen petitioner. It is a clear question saying, "13. List all children of your alien fiancé(e) (if any)". He listed no children. The consular officer will wonder if you neglected to mention the child to your fiance, conspired with him to withhold information or simply misunderstood the question. Be ready with a truthful explanation for this and anything else they ask, since you already put up a big red flag saying, I'm not concerned about accuracy or truth.

This is not correct. All children of the fiancee must be listed in question 13 of the I-129F. Listing the children there does not mean you are requesting the K-2 Visa for them. But you must fill out each question completely and honestly. That question asks for children of the fiancee (beneficiary). It does not ask only for children that will be asking for the derivative visa.

I agree with my long time VJ colleague above. It can be a red flag. When I forgot to include a previous marriage I thought I screwed it all up. You never know what can happen at the interview. I forgot to mention that I had also sent in an amended I-129 with the correct info. This did not delay or change the interview date. For us the CO didn't ask why the annulled marriage was left out of the first I-129 or asked for my letter. They CO did however, go over several times the actual legal anullment documents. She was heavily interrogated about the marriages. St. Lukes even made her see a special counselor who evaluated her personality! So, needless to say, the Filipino government/culture don't like/approve of divorces. Just be ready to explain why the "child" question was omitted/error and consider filing a corrected I-129. You're not the first nor certainly the last who will make a mistake on the I-129. It's not a deal killer as long as you got your bases covered why/how the error happened. In my statement to the Embassy I declared that I had made the mistake and my finance had told me everything.

This is the child of the woman u love so he will be apart of your life whether he follows her to the US or stays with his father,,.

If my SO would even whisper these words under his breath he would NOOOOOOOOOOOO longer be my SO..

YOU LOVE and ACCEPT her , you should Love and accept her children tooo, You dont have to be a father to her sonjust be a role model.

She will need you support and comfort when she leaves her son behind. If you get past the interview by OMITTING the son....
