Hello,

I have a question about the form I-864.

I got married to a US citizen here in the USA and I am filing my application for green card. My husband is working and is doing construction but he always gets paid cash and he never file his money as an income and never filed taxes either. So I am very confused on what to do about the form I-864. On the other hand his mom has her own business and earns good money and willing to file the supporting papers for me, My question is that -- Does she need to fill up the form I-864 and file her taxes too?

And does my husband need to fill up that form too or just his mom?

I would appreciate some answers.

hi,

had a question: I submitted an application for permanent residency/adjust status form I-485 recently. What has been requested of me by USCIS is:

a) a copy of my marriage certificate

b) I-864 (affidavit of support from petitioner)

c) I-693 (medical exam)

d) vaccination records

e) birth certificate

f) proof of lawful admission or parole into the US

I submitted all of the above as 1 package EXCEPT for the I-864. My wife submitted that form separately and at a different time. USCIS sent me a notice of decision by mail the other day denying my I-485 application. what are the chances that USCIS will reconsider their decision should I write in to them? after all, I have submitted everything except for 1 form that went in separately...please advise.

yer USC spouse is the primary sponser - so must file I-864, regardless of income level and tax filing history.

IF he is unable or unwilling to file the 1040X on his prior years income, then HE will FAIL as a primary sponser .

To overcome this, many people get a co-sponser.

The short version - USC files I-864 as primary sponser, regardless of income level, and then a co-sponser files I-864 also.

The 'trick' is to find a co-sponser that has enough income.

(IMO, yer husband is a dolt. He made wrong decision to NOT file income tax returns)
