Hello everyone, I've been reading some of the post on here and it says that the Manila Embassy does NOT accept Co-sponsors for the Affidavit of Support? Is that true? Why? I also read that by March 2010 they are changing the Poverty Line (hopefully it doesn't change by much). Well i've filed my 2009 taxes already and for 2009 I do meet the income requirement. Say, even with the changes in March 2010, i still meet the income requirement, do I still need to bring or show 3 years worth of taxes (2009, 2008 & 2007). Because if I do, 2008 and 2007, I did not meet the income requirement. Pls any help will be greatly appreciated. Another question I have is, my fiance was previously married in the Philippines. He got an annulment and it has been approved. He sent me his paperwork but he was still waiting for his certificate of finality. I mailed in our I-129F package before I even got the certificate of finality. Do you think I will get an RFE for not sending in the certificate of finality. Should I still mail the certificate of finality to the USCIS or just wait until we get approve or wait to see if we get an RFE (crossing fingers we don't)? Thank you for all your help

04-19-10 : TOUCHED on USCIS website & called USCIS, they said its "AMENDED"

04-20-10 : TOUCHED on USCIS website (Dammit send it already)

04-21-10 : Got an e-mail from Congressman saying that USCIS mailed my petition to NVC (finally)

04-23-10 : Received "amended" NOA2 hardcopy in the mail

04-23-10 : NVC received

04-26-10 : Got MNL case # and petition left NVC to Manila Embassy

04-29-10 : Received by Consulate

05-04-10 : Medical Day 1

05-05-10 : Medical Day 2(PASSED)

05-26-10 : INTERVIEW DATE MAY 26, 2010

08-26-10 : WEDDING DAY, WE ARE NOW MR & MRS. STEPHEN AGUILAR PADUA

09-11-10 : MAILED AOS/EAD PAPERWORK

09-13-10 : RECEIVED AT CHICAGO OFFICE

09-20-10 : NOTICE DATE

09-23-10 : RECEIVED HARD COPY IN THE MAIL

01-07-11: INTERVIEW FOR GREEN CARD

01-14-11: APPROVAL OF GREEN CARD RECEIVED

This is a fairly recent memo from USEM in regards to whether they do/don't accept co-sponsors. (They do.) http://www.visajourney.com/gallery/albums/.../36845/USEM.pdf

Regardless of how many income tax returns you provide - they evaluate your income based on what is current, not what you earned 3 years ago. A possible exception is if perhaps you are self employed, but still - the burden is on current income.

Nevermind...i was giving info on the 864 not the I-134 for fiancee visas.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Timeline

If your 2009 Income meets the minimum 125% of poverty line you are in good shape. Bring the previous 2 years, it does not matter if they do not meet the minmum requirement. You will need the Finality at the interview. It does not need to be sent with the 129F. If everything else is in order it sounds like your on your way to a visa! Good Luck.

During our time, my fiance was just recently employed and he didn't have any income for 2009 because he was laid off from work. Needless to say, his good enough proof for affidavit is only for the year 2008 where he was able to work full time and his income exceeded of whats required. We couldn't sleep hours and hours before the interview thinking about possible questions that might be raised. Guess 19th is our lucky day since during the interview his two years of previous income records weren't asked.. rather, the consul just asked for his recent tax returns which was last 2008.

Why 2008 and not 2009? I was prepared to tell the consul that my fiance has yet to receive his w2s from his previous company and that he has until march of 2010 to file for it.

That being said made me prove one thing - the consul plays a huge role in the approval of the case. I guess we all just have to take our chances..

I have read quite a lot of articles regarding co sponsors and surprisingly a huge number of couples were successful at the end of their journeys.. Although, theres always a remote possibility of being rejected but then again.. call it destiny if indeed it will come true.

i have n clue about getting an RFE when u dont include ur fiance's annulment decree in the packet..as for us, we waited for my annulment to finish ..got the decree and sent it together with the packet..if u read the instructions it says ,if ur fiance was married u need to send a copy of decree/finality. Plus ur fiance needs to bring an original copy of the annulment decree during the interview.

we didnt want hassels so we patiently waited till annulment was over before we sent the packet. i just hope everything goes well for u guys.

We are also worried about the changes of poverty guidelines i have no clue if it applies to people who are just about to file( this march 2010) or it goes for everyone including 2009 filers ( hope not)..im still looking for answers. Good luck to us!

were in the same situation, but some says that the petitioner must be currently working, you should prepare your fiance's paystubs and a letter for his employer. :)

I know its better prepared than sorry but in my case I was only asked to provide the latest ITR of my fiance (for 2008). No other questions asked.

I know its better prepared than sorry but in my case I was only asked to provide the latest ITR of my fiance (for 2008). No other questions asked.

They will ask for more evidence when you adjust status. There are different requirements for I-134 and I-864.
