FYI, that money he made in Europe still counts and NEEDS to be back-filed. He won't pay any taxes on it assuming that France is part of the tax-treaty (I assume so since the UK is party to it) up to $88,000, but you could get in serious trouble with the IRS if it's not filed.

Putting aside whether the IRS will get angry or not, you cannot file the I-864 yet, if he was required to file and hasn't.

I just noticed his "under 3000 Euros" earnings, in the first post. To determine whether or not you need to file a return you need to look at each year individually.

The OP stated that he never earned more than 3000 Euros in a year.

So let's look at the 2007 and 2008 cut off amounts

2007 - Married filing separately - $3400

2008 - Married filing separately - $3,500

Now I don't know what the Euro vs the U.S. dollar was doing in 2007 and 2008, but from the little bit of research I have done, it looks like he may well need to file if he is over those thresholds.

I was using the Bank of Canada Exchange Rates tool here btw.

Yeah that's right...probably best to do it to be sure and have peace of mind.

I'll call the IRS tomorrow to make sure we do everything right.

I have yet another question though:

I am on a J-1 visa that will still be valid until May 20th of this year. I am planning on filing both the I-130 and I-485 together before the end of February (hopefully!).

Will I be allowed to stay in the US while my application is sent and waiting for approval? I'm very afraid to overstay and face some sort of ban.

Also, I'd like to file (at the same time) for an I-765 Form in order to work while my AOS is pending. Do I have to pay for the I-765 on top of the I-485 and I-130 filing fees?

Thanks a lot in advance, you guys are of HUGE help to me.

your status will be 'AOS PENDING' after you receive the NOA-1 notice - you will be allowed to stay without worrying about the expiration on the student visa

Also, I'd like to file (at the same time) for an I-765 Form in order to work while my AOS is pending. Do I have to pay for the I-765 on top of the I-485 and I-130 filing fees?

the EAD fee is waived with the I-130 fee, if you file I-751 with the I-130, concurrently

So yep, according to an immigration lawyer (one of those free phone consultations) we actually don't have to prove his tax exemptions for 2007 and 2008.

The only mandatory thing is the tax info from 2009.

However, Darnell, you said:

I'm really afraid I'll have to look for another sponsor. Even if my husband is making enought money now and can prove it.
