Affidavits filed before the new effective date will be held to the current 2009 standard.

There has been a delay in the new poverty guidelines going into effect. The new poverty guidelines will not be published before March 1. Once the guidelines are issued by US Health and Human Services the new I-864P will be issued by USCIS with an updated effective date.

From the USCIS I-864 FAQ:

Income Requirements and Poverty Guidelines

The Poverty Guidelines in effect on the date when the sponsor files the Affidavit of Support with National Visa Center or with the U.S. Embassy or Consulate, will be used to determine whether the income requirement is met. For example, the 2006 Poverty Guidelines, I-864P, footnote states the effective date was March 1, 2006. So, if the sponsor filed the I-864 with the NVC on February 1, 2006, then the 2005 Poverty Guidelines would be used.

The poverty guidelines document is the I-864P here: http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=73c63591ec04d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

If and when there are any updates they will be reflected here. Note the current version is dated 13 Feb 2009 so no updates since then.

At the bottom of this form it says "These poverty guidelines remain in effect for use with Form I-864, Affidavit of Support, from February 13, 2009, until new poverty guidelines go into effect in the spring of 2010. I know March was supposed to be when they would introduce the new fees. However, instead of it going up as it usually has done, it decreased, so rather than lower the poverty guidelines, they took action to freeze the guidelines from 2009 until March 31st...

^^It looks like more recently they've extended it throughout the end of this month.
