I'm sure what I'm feeling is familiar to most if not everyone here. I've been swinging between frustration, anger, depression and tears and feel powerless to do anything which just adds to my frustration.

For purposes of this topic, I'm referring to our I-130 petition, since I couldn't care less about the I-129F now that it will most likely be closed. It may be a factor, I don't know, but perhaps someone here will.

My I-130 NOA 1 shows a "Received Date" of October 2nd on the notice. To date, at least according to the USCIS "Check Your Case Status" website, my petition hasn't even been touched since October 26th, when I presume they just married the I-130 and I-129F petitions together.

I have scheduled an InfoPass appointment for March 3rd - exactly 5 months and 1 day from the received date on the I-130 notice. Starting on that date, I plan on bombarding USCIS with inquiries. In addition to starting daily calls and written inquiries, letters to both Senators and my Representative along with the CIS Ombudsman, I plan on bringing the following information with me:

* All information and documents originally submitted with the I-130 and I-129F petitions.

* A copy of the I-130 NOA1 with the "Received Date" of October 2nd highlighted, as well as the statement "If you have not heard anything regarding your petition it is because we are processing petitions received before yours" (or something to that effect).

* Screen shots of time lines showing petitions received and approved AFTER ours.

* Screen shot of USCIS "Check Processing Times" website showing that, in their own words, if the last petition they processed was within their set guidelines, the processing time on the chart will show "5 months".

I plan on asking USCIS to abandon the I-129F petition and move forward with the I-130. I also plan on asking for an expedite, since I'll be using their own information against them, and figure if their information is erroneous, it equates to USCIS error.

I may be nitpicking, but it's all I've got at this point. I know I won't be satisfied with "check again in 60 days".

So, my questions are:

* Will bombarding them with phone calls and paperwork only succeed in pushing back our petition?

* Does any of this matter? At this point, even if it doesn't speed up our petition (as long as it doesn't slow it down), I am just feeling spiteful and hoping that some adjudicator in USCISland will feel just a fraction of the irritation that he/she is currently putting us through.

* Will they even bother closing the I-129F at USCIS or will they make us go through with it?

* Is all of this just a waste of time?

* Are Hobekenworkingman and me the ONLY two going through this? It's feeling pretty lonely in the K-3 forum right now...

Being anything but nice while being assertive would be a mistake, IMO. An infopass appointment will do nothing. Don't mess with the I-129F. Any harm has already been done, so don't chance doing more harm. There's no need to ask for an expedite, as your inquiry is likely to trigger one anyway. Contact your State's senior US Senator's office for assistance.

Being anything but nice while being assertive would be a mistake, IMO. An infopass appointment will do nothing. Don't mess with the I-129F. Any harm has already been done, so don't chance doing more harm. There's no need to ask for an expedite, as your inquiry is likely to trigger one anyway. Contact your State's senior US Senator's office for assistance.

I would contact your local senator or congressperson as sometimes an inquiry by them can give your case a nudge and get them looking at it... Most senate and congress reps have a specific person on staff that handle these requests...

I dunno - this is a hard one to call.

It does 'scan' like yer loaded for bear, when D-Day occurs, though.

5 months is 'the current average'. I remember when it used to be 6 months. I whooped and hollered and brewed up a special batch of beer when it changed from 6 months to 5 months - thinking that something actually changed in the operational stuff.

Alas, nothing changed in the operational stuff - instead - the 'huge amount' of petitions that were filed before the fee increase FINALLY made it out of the USCIS. That fee increase got a lot of folk 'off their @sses' and they wanted to file cheaply. That pile o petitions SLOWED DOWN both service centers for about 11 months (maybe longer)..

Fast Forward to NOW. Processing of Petition Types , and the throttling of same, varies at the whim of the director. If he sees a backlog, then he'll issue directive to actually shift more personnel OFF of one petition type, to ANOTHER petition type, to flush out the backlog. I was quivering with delight when I saw reports of I-130 petitions coming out of CSC having 1 month between NOA-1 and NOA-2 last year. Sadly, that 'spur to movement' has backed off a lot this quarter and the last quarter.

IMO, you should be happy with 6 months. if you get 5 months, you should be f*cking ecstatic, with MOEs (multiple orgasmic experiences) thrown in for good measure.

I wouldn't 'jump' at 5 months tick mark, at all, if I were you. But that's just me.

As far as waiting another month...not being the most patient person in the world (in fact, being one of the least patient people in the world), I'm not sure I could make it another month without imploding.

I'm going to start with 5 months and see what I can do, contacting my Senator, and trying my hardest to be firm with some sweetness that I most definitely will not be feeling, thrown in...

We'll see if it gets me anywhere. I've doubted Push's advice before, and look where it got me.

As far as waiting another month...not being the most patient person in the world (in fact, being one of the least patient people in the world), I'm not sure I could make it another month without imploding.

I'm going to start with 5 months and see what I can do, contacting my Senator, and trying my hardest to be firm with some sweetness that I most definitely will not be feeling, thrown in...

For what it's worth, my data indicates the average NOA1 to NOA2 for an I-130 is three to four months with some a little quicker. The five month standard is nothing but a CYA statement.

I really hope that you hear some good news soon! I was feeling just like you about a month ago, and I filed about a month before you, so while my opinion in no way is scientific, I would say that you should be getting a text message/email any time now. I didn't wait for the 5 months before contacting my senator, I waited about 4, and the day after the senator's office contacted CSC our petitions were approved, so it probably wouldn't hurt to shoot an email to them or to make a phone call. Hang in there, it will happen soon!

I wonder if that was coincidence or if it actually lit a fire under someone to get it done? I've tried calling USCIS (once) and just had (a very sweet, and empathetic woman, by the way) read to me, verbatim from the I-130 notice. I figured it wouldn't be any good to do any inquiries before the 5 month mark, but now I'm wondering if an early letter to my Senator wouldn't help?

It probably wouldn't make too much of a difference, as there is only 7 "working days" until March 3rd, our 5 month mark, anyway.

Well, you never know how long it will take for the Senator's office to reply. It took our about 2 to 3 weeks after sending the email to get a response, which is why maybe a phone call to them might be better. I don't know if it was a coincidence or not. It's hard to say because the Senator's constituent liaison contacted us and asked for some more information and later that day she told us "They said that your case has been forwarded to an adjudication officer and you will hear something within 50 days." So I was a little discouraged thinking it could take another 50 days, but that night it showed that our case had been "touched". I figured they had just pulled it up to take a look at it when they were contacted. The next two days in a row it was touched too and a couple days later we got the email/text saying it had been approved the day after they were contacted about it.

Anyway, I suppose every case is a little different. My wife is pregnant, and the Senator's office mentioned that, but I really don't know if that has anything to do with it, because from what I have read pregnancy isn't a good reason to expedite anything, and at USCIS we are viewed more as a number and not as real, breathing human beings.

It shouldn't be long now though. I wouldn't be surprised if you don't have to end up making any inquiries at all and you are approved soon. I'll be thinking about you guys and crossing my fingers. :)

I'm convinced. Monday morning, it's a call to Senator Feinstein's office. I can't imagine it can make things any worse, can it?

I dont see why this would be any problem to contact the senator.. What makes it messed up to me is that I had my case expedited because of the military. (I KNOW THAT IS A DIFFERENT SUBJECT AND SITUATION WITHIN ITSELF) But I had the lady from the uscis call and tell me to fax all the information that I was missing so that it could be sent to the NVC. Now i say that to say this. If I can get get my "own personal USCIS lady" at least thats how i seen it. Why can't the senator do the same or at least get it looked at so that something can be done... I'm just a no body thats a senator we are talking about... Just think If it gets approved the day after you contact them either it was because it was time or the Senator had something to do with it. So IMO I say do it get a fire started plus nobody can really say if it will make things worse or not because it seems to me that everything with the USCIS is a ####### shoot. Either way good luck.

OK - any news to report? wassup?

I faxed Senator Feinstein's office yesterday morning and have been on standby waiting for a reply. At one point I tried to call her office, but her line is always busy, and it's difficult to get the time to try over and over again from work.

I have an InfoPass appointment a week from tomorrow. I don't believe that the Senator's office can do anything before then. I figured I'll give it a few days and wait to hear anything.

Still no approval & no touches on either petition...
