This request for info goes out to all visa journey "alumni" who have had their interview and either have or are waiting for their VISA.

Did any of you visit the U.S. during the I-130 or K3 process? If yes, did you have any problems at the interview because of the visit?

Thanks in advance for your help.

I have heard different rules. I have been told that you can't cross the border while waiting, then one day I was at the border crossing, and talked to immigration/customs. They basically said there is no official rule that you can't cross, but you may have to prove that you still reside in Canada. They told me once I file, to bring any bills, pay stubs, etc and keep them in my car just in case so I can show them. I have met another Canadian girl, who has filed, and goes to visit her husband everyweekend, and has never had a problem yet. Her I-130 was just approved and waiting for an interview date. I just hope I can still go and visit once we file. But then again, I could've been told the wrong info from customs/iimigration at the border. Been told so many different things, I don't know if I'm coming or going!!

Jul 18/2007: Case left NVC on way to Montreal

Aug 31/2007: Rec'vd 1st interview letter (the one they DIDN'T send me, due to NVC having my address tagged as bad---this one was hubby's that I got 5 weeks late.)

Aug 9/2007 : 1st Interview Date (of course I missed it)

Sep 15/2007: Rec'vd 2nd interview letter

Sep 26/2007: Medical Appt booked

Oct 5/2007: 2nd Interview scheduled in Montreal

Oct 5/2007: Approved!!!!!!!

Oct 11/2007: Recv'd Visa in hand after hearing doorbell ring

This issue gets brought up on a weekly basis here on VJ. Canadinas seem to be a bit luckier than most, as we are neighbors with the yanks, and if you do get denied, its not a major hassle as it could be with other counteries.

Many Canadians have travelled to the USA while the visa process was ongoing and never had aproblem, and there have been others that have been denied. I travelled monthly to DC and never had a single problem. All seems to come down to the POE officer. And I would assume it matters how you carry yourself. Dont bring tons of luggage, look presentable, try not to be nervous and answer the questions honestly, but dont add a lot to them!! Thats just my experience. Andf have a plan if you do get denied entry! Do a search on VJ and i'm sure you will come up with other experiences. best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

One thought: If you fly out of Vancouver or Toronto, you have to pass through US Immigration before leaving Canada. Someone with more information can proably elaborate on this but I read somewhere that if you're refused entry, since you're not on American soil you can withdraw your intent to enter the US, and therefore won't receive an official denial (though they may note on your file that you tried to enter and were refused). Comments, anyone?

The reason why my wife cannot come down is because they took her picture and printed her shortly after we married. They said she couldn't re-enter back in the US until she provided leasing contract, bill stubs, etc, etc.

She cannot provide all this because she's a student, unfortunately.
