What to do for a wrong info on my notice of action

Hi all, I am so ecstatic to finally get my I-797 in the mail today. It says the above petitioned has been approved. It also said that The petition indicated that the person for whom you are petitioning is in the US and will apply for the adjustment of status. That's when the problem kicked in because my mom is in the Philippines. The next paragraph says if the person decides to apply visa outside the US, I need to file form I-824 so I was in the impression that I should do that instead although it seems like something is wrong cause I-824 is basically a request for NVC to determine which consul my petition will be sent. I checked the copy of my I-130 and I filled it out correctly so I contacted uscis, took me 30 mins to get to an operator, I reported the issue and I was told that they will look onto it and it will take 45 days. Is that normal, why should I suffer for their mistake? I was also asked to call the NVC since the visa is already approved, she doesn't really know if they will be able to help me. Anyways my question is, sine this petition is already approved, is there anything I can do in advance while waiting for them to send me a corrected notice and us that notice even gonna matter? I am just so lost right now, instead of celebrating i'm freaking out! Is there anyone of u had the same problem and what action have u done. Thank u so much for listening, any advice is aapteciated!

I filed 130 petition and 129F/k3 petition for my wife and the same thing happened on our 130 approval - said petition indicated she was in the United States and need to file i824 (plus $340 fee) to apply for visa at consulate. The operator said could take up to 100 days to get i824 approved. Luckily our K3 petition was accepted to the NVC so we are gonna take that route.

I really don't know how the 130 got messed up, it is written in 3 different places that my wife is in Brazil.

The operator said could take up to 100 days to get i824 approved. Luckily our K3 petition was accepted to the NVC so we are gonna take that route.

I really don't know how the 130 got messed up, it is written in 3 different places that my wife is in Brazil.

DISREGARD MY COMMENT -

Apparently USCIS is clueless. After getting complete misinformation from several operators at CIS I contacted the NVC directly. The operator said that this happens a lot when there are changes in processing procedures but not everyone knows the system yet.

I would call the NVC for sure to resolve this issue - don't get tricked into paying another $340 by them.

Same thing happened to us. Our I-130 was approved on november 2, we have been trying to get it to be send to the NVC since then, USCIS is helpless when it comes to it, they want us to file the I-824 and wait.

Our lawyer is working on it, but got nothing from USCIS. We have contacted our senator this last week and are waiting for a response. I advice you to contact your congressman/senator about it as soon as you can.

It seems that USCIS has been making a few mistakes like that, I know at least two other VJ member who are going through it somehow.

Same thing happened to us. Our I-130 was approved on november 2, we have been trying to get it to be send to the NVC since then, USCIS is helpless when it comes to it, they want us to file the I-824 and wait.

Our lawyer is working on it, but got nothing from USCIS. We have contacted our senator this last week and are waiting for a response. I advice you to contact your congressman/senator about it as soon as you can.

Same thing happened with our petition. We also contacted our senator's office and explained the situation. It took close to 2 weeks to have our case assigned to a case worker. She contacted CIS yesterday, and we received an amended notice of approval today! I would suggest you search your senator (go to this link to find the senator representing your area : http://www.contactingthecongress.org/) and then read on their website about they how they can facilitate the contact with a federal agency. That particular section will include a release of information form that you will need to fill out. Additionally, you should include a description outlining your current problem. Then, fax these forms (the release along with the letter) to the appropriate office (the release of information form should specify where to submit this fax). After doing this, contact the respective office and make sure that they got your documents. Then wait... It may take about 2 weeks or less to have your case assigned to a case worker, but h/she will contact you when this happens. At that time, explain the situation and ask for her/his help. It should be resolved promptly. Good luck! I can completely empathize with your situation!
