1-134 question

i'm a little confused on #8 on the 1-134. if i claim my mom as a dependent on my 2009 tax return, do i have to put her name on #8 of the i-134 form? also, is it ok if i checked partially dependent instead of wholly dependent? as stated in the choices, she after all is not wholly dependent on me financially. and i'm only claiming her for 2009 because she used to live with me last year. she no longer lives with me anymore so i don't know what to put. do i still have to include her in #8 just because i will be claiming her as a dependent for 2009??

No, if you will not list her on taxes going forward such as 2010 you do not list her on the I-134. Although if you will continue to provide some support then you need to still list her as a partial dependent. Just fill out the questions as the situation is currently and correctly.

You can fill out the form for the circumstances from present time and going forward without misrepresenting or misleading in your statements. You will be entitled to still list your relative on your 2009 taxes.

Agreed but this only matter if income qualification is tight. If it isn't, I think it would save confusion to list her as a partial dependent anyway. It avoids the beneficiary having to explain the change in circumstances. If the OP decides not to list her, I'd advise adding a letter explaining why.

also, if i did that, will my household therefore be 2? meaning me and my fiance only? cuz if i have to include my mom, i'll be way under the poverty guideline. but if i attach the letter as u said with my explanation, i'll still be under, but not in great amounts. i really hope the CO will look at thee 100% poverty level rather than the 125%. i've read from several vj members it's with the discretion of the CO. some were accepted and others were denied. another one of my concerns are cosponsors. i know philippines is really strict with this. lots of people have been denied too, but not all. i definitely will need a cosponsor, so i really hope having one will not be a problem. anyway, getting back to the household situation, like i mentioned earlier, my mom no longer lives with me therefore i think she shouldn't be included in the household members anymore even if i claim her for my 2009 taxes.

If you list her, your household size will be 3. If you don't qualify, be prepared both with a co-sponsor and the knowledge even that is unlikely to be accepted in Manila.
