I have a divorce decree from the court house, but there is no stamp or seal of any kind on it. Do I need to go there and ask for them to notarize it? What I have is what they gave me once the divorce was final, at least a copy of it. It has the date and the judge’s signature on it, but there is no seal or notary of any type on this paper. Should I just go and get a new one and ask for them to stamp or notarize it? If they will do this will it be acceptable or is there some special form or way it needs to look. Thanks Jerome

Different states and counties have completely different looking divorce decrees. A "certified copy" will usually have some sort of stamp and signature by the court clerk, certifying that the document is a genuine copy of the original they have on file. You probably have a copy of the decree the judge signed, but not certified by the court clerk. Take your copy to your court clerk's office and ask them if it's a "certified copy". If not, have them make you one.

Response to your big questions. You need a couple of thing to get marry in Vietnam. First and foremost, you need to get test for a couple of diseases like HIV and fill out a "medical certificates for marriage." check out this site for more info, http://travel.state.gov/law/citizenship/citizenship_766.html

I don't ever remember having to get a HIV test or disease test when I married my wife in Vietnam. I remember getting a mental test and seeing if I was mentally fit to have a wife.

That's is weird. I did the opposite thing. My wife did the mental test (I did not do one) and I had to take medical test for HIV.

I agreed, I never take any HIV or other disease test. All you have to be prepare is your are single, and getting a SINGLE STATUS, and sign your married certificate in VN.

Only mentally test.

I got all the paperwork yesterday, on the websites they say they also want from the state you are living in a authenticated statement that says there is no marriage's in the past two years. In Indiana they have no way to do this accept to go to every county in the entire state and have them check. So what I did was I had the woman at the Clerks office int he county where I live give me one and in it she stated "a search for the whold of Indiana at this time is unavailable" Will this be acceptable? Just want give you a heads up on this, every single paper that you got from U.S, it must be certified by Vietnam Embassy, this is a long way to go…. I’m not sure if “So Tu Phap Tp.HCM” (I assume that you are getting marriage in Saigon) will accept the papers without Vietnam embassy certified. But if the papers from U.S Consulate in Saigon, it will acceptable. It happened to my friend.

Since you’re going to stay in Vietnam more than 3 months, if I am you, I will do this…

1. Make a phone call to US Consulate in Saigon, I’ll ask if they can provide me the Divorce decree and Certificate of No Marriage Record, and what is the waiting time for me to receive it, costs.

2. I will ask my wife make a trip to “So Tu Phap TpHCM” and ask them if they’re going to accept the papers from US without Vietnam Embassy certified.

You need clarification two things above, and make your own decision. I just want to help you out a bit before you go.

In order to get marriage in Vietnam, these papers will be needed

1.Application for Marriage Registration

2. Affidavit of Single Status (both version, Vietnamese, English)

3.Certificate of No Marriage Record (if married, Divorce decree requires)

4.Certficate of Good Mental health

5.Biographic Information Sheet

6.Copies of Passport.

And it MUST

A. Public Notary

B. County Clerk Certified

C. Secretary State Certified

** Since you’re going to do all the paperwork in Vietnam, you will then need the number 2 & 3.

If the County Clerk found NO record, you’re done.

I'm not sure if "So Tu Phap Tp.HCM" (I assume that you are getting marriage in Saigon) will accept the papers without Vietnam embassy certified. But if the papers from U.S Consulate in Saigon, it will acceptable. It happened to my friend.

Since you're going to stay in Vietnam more than 3 months, if I am you, I will do this…

Just to chime in my 2 cents the health exam can take place in Vietnam, I got mine done here and it only takes a day to get the blood results done. Other then that what the above have posted is generally true you will want those documents translated and certified by the Vietnam embassy.
