Hi everyone

Im getting mixed messages from everywhere and feel my head is abt to explode so please forgive me.........i married my husband us citizen in sept 09 im a uk citizen we have finally got money etc sorted and he is sending i-130 now lawyers seem to think 5 mths and i will be there!!! well after the looking into it i have done id say more like 9-12mths!!! also told me im not allowed to enter america whilst waiting on this?? is that true?? i told him that it seemed longer he said no you'll be here july/aug im renting a prop at the moment and its so stressful as i have a young child and obviously need to get rid of my belongings and now need to be out by end of june so looks like we will be living out of suitcases hoping someone will put us up for what he makes out to be a few weeks but i think maybe few months??????........... awful as anyone who has property to rent doesnt just want to do it month by month... please tell me if im being crazy abt all this but feeling really deflated tonight x

You can still visit your husband on the VWP, but it's best to take evidence of your ties to the UK in case you're asked for them at the POE.

thank you i thought so but didnt want to say the lawyer was wrong just feel so so low with it all tonight x

We were told the same thing by our attorney and as we didn't know any different, my hubby did all the traveling to visit me whilst the process was ongoing.

As for the visa process..ours was filed in July and approved last week, so it took almost 7 months to the day.

xx thanks so much ..you presume these attorney's know everything i told my husband im sure i could travel he said noooooooooo if he said u cant then he must know!!! i mean i have learnt now that its not allowed but in theory it makes more sense for me to book a flight say august on my visa waiver and wait there till approved doesnt it but obviousbly that not way law works!! be easier seeing as have a home and husband there and nothing here at end of june! sorry at hair pulling out having a teenage (i wish) temper tantrum tonight xx

If it helps Im currently on my CR-1 application process and the border patrol let me through to visit my husband while on my spring break from University. It was my first visit since starting the application process so I was very nervous but everything went pretty smoothly. I had tons of evidence I brought along with me to show that I was still tied up in canada(enrolled in Uni, letter from landlord, school work, and that I was funded by indian affairs for school so I couldnt just leave! lol)

As long as you have strong ties to the UK; show your leasing agreement for your apartment, letter from your employer or anything that will show that you do not intend to immigrate during this visit you should be fine. Although it is up to the border control people to decide whether or not you are allowed in to the states; so there is also a risk of not being able to visit your husband.

I was in the same predicament and worrying.

I married my USC wife last July. I have been over twice since to visit and not a problem. It was ironic really. I used to have more hassle before we got married.

If it is any use to you, we filed on July 25th last year. I have interview in London March 5th. We had a slight hiccup back in October when they asked for further evidence. So who knows it may have been sooner.
