Citizenship based on Marriage, or 5-Year Rule

Out of curiosity, I've been browsing various forums on N-400 applications and would love some clarification on one topic!

I've read a few times now that people actually suggested that even genuinely married couples should wait to file the N-400/Citizenship application so they don't file after 3 years based on marriage, but after 5 years based on the 5-year rule. That way they avoid getting caught in some insane super-scrutiny from USCIS that could cost them everything if they don't have a massive pile of bona fide proofs, and instead just show that they had a green card for 5 years and use that as the basis for the N-400 which supposedly makes the process much easier.

Is this true or bad advice?

Bad advice IMHO.

If you have nothing to hide, and have valid evidence, file when your able to do so.

Why wait?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Worst case scenario, if the IO feels that you are not eligible to apply based on 3 years, then you will have to wait until 5 years before applying again. The 2 year conditional residence has already proven that you have a real marriage and relationship, but to allow you to naturalize, you will need to show them that you are still married and you are eligible for 3 year naturalization. You are currently an LPR and that's that.

06/30/11 .. Package Delivered to Dallas Lockbox

07/06/11 .. Received e-mail notification of application acceptance

07/06/11 .. Check cashed

07/08/11 .. Received NOA letter

07/29/11 .. Received text/e-mail for biometrics notice

08/03/11 .. Received Biometrics letter - scheduled for 8/24/11

08/04/11 .. Walk-in finger prints done.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

File after 3 years. I did certainly no massive scrutiny, if fact hardly much of any sort of scrutiny.
