Hi,

Me and my husband have been "debating" this question for awhile now. I'm currently waiting for AOS approval and haven't yet recieved my EAD. According to my timeline EAD will be approved around 22nd feb-march 1st.

The problem is that teaching jobs for the next school year are now coming out. I (fingers crossed) will have my GC by the time school starts but can I apply for those jobs now? I won't be working until August.

It's a dilemma, I think I can't apply but it's hard to know that I could be missing out on jobs. Hubby thinks that they won't be asking for documentation until interview which hopefully by that time I'll at least have EAD, therefore I should apply.

I appreciate any thoughts.

Amanda

You could apply - but they will not actually let you work till you have the EAD/GC.

(well - if the company follows the rules).

It's my experience they ask for documentation with the job application - your mileage may vary.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This is my opinion, and it is only an opinion. Since you cannot work until August (as a teahcer), I don't see why you can't apply for the job now. They will ask for your social security number etc. on the application. HOWEVER, a lot of the initial screening process for jobs requires a RESUME and a social security number is not REQUIRED on a resume. If they make you fill out an application, just have a piece of paper already printed out with your immigration status on it, and explain what's going on in a very professional manner. I cannot see any reason why someone would NOT accept this as a valid application. Tell them you will provide the information as soon as you have it, and follow up with them even if you don't get the job. At least it shows you follow through, and in a teacher should leave in the middle of the school year...then your app is ready to go ;).

In my experience, the documentation about ability to work is required after the job has been offered. (Not sure how things translate for you, but for many professionals it goes submit resume -> interview -> offer -> "application" (where you fill out info like work authorization and such)

The exception to this was when I was doing temp work - then I needed to do all of that paperwork before I actually knew what I'd be doing.
