Hello all, my apologies if this is not the right place to post this question but here it goes...

My husband and I are planning to submit the paperwork for his Adjustment of Status next week. I heard that if we apply for his work permit, we will receive it about the same time as his green card. My question is, how many of you guys applied for the work permit and if you did receive it almost the same time as the green card. I would also like to know if the work permit will no longer be needed if my husband already has the resident card.

Hello all, my apologies if this is not the right place to post this question but here it goes...

Why not apply for it? Doesn't cost anything more than the $1010 you pay anyway and if there are any delays in the GC, at least you're not stuck waiting for it. From what I've read, the EAD arrives before the GC, although if the GC is very quick then they can be a comparatively short time apart.

You're right that once the GC arrives, he'll no longer need to use his EAD.

We went ahead and applied for the EAD card since the price is included for the AOS. The EAD card arrived about 4-5 weeks before the 2 year conditional green card. It came in handy for us, not for work but as a 2nd form of ID (other was passport) for my wife.

If may be of some use if you AOS is delayed etc. or as another form of ID like for us.

You always apply for the I-761, whether you need it or not. It doesn't cost a penny, and it doesn't hurt to have it.

No it will not cost you the additional 340 if you file it with the 1-485 application.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

The EAD is included in the same fee with the AOS so apply for it. While the green card is probably going to be processed quickly, you never know when you might run into a snag. If the green card gets delayed, you will be thankful to have the EAD as proof of US legal status, of ability to work and as a government issued form of ID. My AOS took 22 months to process and I actually had to apply for a 2nd EAD. You never know what will happen so it is best to put yourself into the best position you can. You can also apply for the I-131 at the same time as there is no separate fee for that as well and it usually arrives within 60 to 90 days. It is great to have in case of an emergent travel need before the green card if approved.

His arrival was Dec 29, 2009. We got married on January 15, 2010. His K-1 visa expires on March 24, 2010.

Do we have to do his AOS before his 90th day here in the US?

I would apply before that "90 days" grace period expires.

And yes, please apply for your EAD. Look at my timeline. My AOS application is facing a major delay due to some bureaucratic issues related to a simple change of address. I just applied for my 2nd EAD. I wouldn't be able to drive and work without it.
