I read a few post on here that says instead of waiting for a letter from USCIS which could take a very long time. That an option would be to refile the same petition. My husband was denied in November. The interviewer said our marriage is for immigration purposes. Our file is now in the US under review. Should we wait? or is it better to just file the petition again with more evidence etc? What happens next when they review the file? Does it really take years? Has anyone gone though this and got approved? Any advice please.

Full details of your case would be needed to help you judge what is best for you at this point. However, what you can be sure of is that the issue of "evidence" is probably not something you're going to do with paper alone. Time spent together building an actual bona fide relationship is what will carry the day at any interview. Paper evidence just backs up the facts. The actual facts and the interview are what carry the day.

Facts are cheap...knowing how to use them is precious...

Time spent together building an actual bona fide relationship is what will carry the day at any interview. Paper evidence just backs up the facts. The actual facts and the interview are what carry the day.

I am not sure what you mean by full details. Our case was going smoothly things were moving ontime. We assumed everything would go well. My husband interviewed in October 2009 by and Asian lady, he answered everything correctly. My husband said that she denied everyone that came before him. He was put on AP they kept his passport so we thought it was a good sign. He had a second interview in November 2009 by a white man. He was very rude to my husband. He told my husband that he was the judge and he is judging him, he said your marriage is for immigration purposes. He did not look at any of my husbands evidence. They lost his passport, My husband finally got that back. Now our case is in US under review.

Details of your case would include such things as....

1. How you met

2. How much time you spent together, where and when

3. Your ages

4. The evidence presented

5. A detailed report of the questions and answers at both interviews

6. Information on previous marriages and divorces for beneficiary and petitioner

In short, there's a reason the case was thought to be fraudulent. The reason or reasons will be evident when the details described are carefully reviewed by somebody equipped to do so.

I guess you two are married but living apart, one in US and the other in your husband's country? If you are living together, you should be able to supply ample evidence of a bonafide (genuine) loving marriage such as photos and trips, etc... But also since you are married, can you mingle your finances. This is often important for marriage and AOS after a marriage. Can you get your husband a credit card so you share an account, an ATM card, and show other signs of attempting to make a real and legitimate marriage.
