Hi,

I need for my fiance to get papers showing full custody for her son. She told me about bienestar familiar. I heard it can take up 6 months or longer to get the custody papers. Is there attorneys in Colombia that can do it much faster?

She talked to 1 attorney he said he can get it done in 10 months

Another attorney says 6 months. But that's the same amount of time it takes without using a lawyer.

Getting full custody of a child in Colombia is a very long and sometimes difficult process because Bienestar Familiar, which is the equivalent to Child Services here in the US, wants to make sure it is done in a legal way and they also want what is best for the child. It's easier to hire a lawyer just in case there are bumps in the road, plus they know the ins and outs of the whole process. In all honesty most cases I've heard of have taken at least 12 months.

Thank you so much for your response. You really helped me with your answer. I was really unsure how long it would take. I will use the lawyer down there.

God bless you!

Getting full custody for your fiance's son could be a long process or not. If her exhusband or her son's father is agree, they only have to go to Bienestar Familiar and give to her the custody. Is her son living with her?? he will also have to sign an authorization for the kid to get out of the country, in other case she will have to start a legal process in Colombia, proving that her kid is going to have a better life in the states.

She was never married but the guy was never in his son's life. I talked to her and a lawyer told her that he thinks the case will not be compilicated because the father has never been there.

He will not sign any document because he is on the run from the police. He commited a crime against a minor.

She will have to start a process asking for full custody since the father is not gonna sing any document for reason you mention. this will be easy but she has to follow the laws and procedures. I will suggest you to hire a layer.

Good Luck.
