Timeline

Hi All, my fiance arrived to the US this weekend and in his I-94 he received the employment authorization Stamp. I was wondering if that is the only # he will need to work?? He does not need to apply for his SS# to start working since he received the stamp?? I'm guessing after we get marry we apply for hi SS#/permanent.

September 15th 2009---Package sent to Consulate

November 4th 2009---Interview :)

November 18th 2009---K1 visa Issued

The first SSN he receives will be his only SSN, and permanently assigned to him for life regardless of his status.

The stamp on the I-94 is no longer a valid stamp to be used for working, but may, in some cases, be useful for getting an SSN.

I'm going to assume he entered the US through JFJK which is the only POE that still routinely issues this 'temp. work authorization'. The reality is, that will not allow him to work. To work, he (you guys) will need to file for AOS and EAD. Either will allow him to work - almost every employer will require him to have a SS#/Card too.

You should follow the K-1 Flowchart (found in the Guides) which suggests you apply for the SS card shortly after arriving in the US - you do not need to wait to do so after you've married.

Thanks for your responses, yes he entered the US through JFK...so eventhough it says employment authorization(is really not) and it gives me a SS# which expires on the same date of the visa, it will not be accepted by the employer?? is this the only problem... but if it is accepted by the employer he will not get in trouble with immigration for working?? since it does say employment authorization?

Also the stamp issues a SS# do I still need to get another one after the two weeks he is on the States?

First of all - you did not get a Social Security number at the airport (not on the I-94, not anywhere). Social Security numbers/cards are issued by the SSA and you would need to go to their office to apply for one.

Secondly - you are correct, the temp. EAD stamp he got is not enough to work on (its a long story but it just is that way). An employer has to fill out an I-9 for every worker (foreign or not) and that Temp. EAD is not part of what is permitted to show work authorization. It just isn't and no proper employer will let themselves be exposed to that kind of trouble.

To be allowed to work and enjoy life the fastest - you guys will need to get married and file your AOS (and EAD and if desired, AP) as soon as possible.

To work, he will need:

  • Social Security Card/Number (issued by the SSA)
  • His EAD (employment authorization document/card) or PR/Green Card

You might, also, want to get a current rev of the I-9 form, study the instructions. You SHOULD FIND that the EAD stamp is NOT sufficient, per the I-9 document.
