Do i really need a lawyer on the interview day?

Hello everyone,

I need your help cos i'm freaking out! :help:

Ok, so my husband has been married once before and filed AOS for his ex-wife.....

Unfortunately, or fortunately for me, their 2nd interview was denied in 2004 and the whole thing ended in a divorce.... Although he wasn't able to get a divorce until 2008 because she was nowhere to be found...

Well, i was talking to a friend of mine who was a bit concerned about my interview saying it might raise some red flags since my husband was previously married and filed for AOS

And since my interview is in 2weeks she suggested i get a lawyer...

Has anyone had the same experience and how did his/her interview go? plus did you get a lawyer?

January 2003: Arrived in USA with F-1 visa

April 2003: Was introduced to hubby thru a friend

August 2004: Met him for the first time in NJ and the rest is history

March 2009: Got engaged

August 28, 2009: Got married to my loving boo

October 2009: Went for medical and vaccines, didn't know i had to have the HPV shot, so went to get it

December 1, 2009: Sent in AOS forms I-130, I-485, I-131, I-765, I-693 and I-863 to Chicago Lockbox.

December 12, 2009: package was sent back & rejected due to no signature on I-130

December 14, 2009: signed form I-130 and sent all forms back to Chicago Lockbox

December 16, 2009: delivered and signed @11:15am

December 22, 2009: Check cashed

December 24 or 26, 2009: All 4 NOAs received.. all dated Dec. 21st (didn't check my mailbox, was out of town)

December 28, 2009: Biometrics appt letter received for Jan 13th

December 31, 2009: Walk-in biometrics. Original appt - Jan 13, 2010

February 12, 2010: Card production ordered for both EAD and AP

February 15, 2010: I-131 Touched

February 18, 2010: I-765, I-485, I-130 Touched

February 20, 2010: EAD received in the mail...

March 2nd, 2010: Initial Interview...

March 2nd 2010: Green Card approved...Thank you Lord

January 20, 2012: Filed for Removal of Condition

January 27, 2012: Received Notice for Biometrics

February 10, 2012: Walk-in Biometrics, Feb 24, 2012: Original Biometrics

June 18, 2012: Rcvd NOA that Removal of Condition has been approved

10 Year Green Card Received... Thanks Everyone

06/28/11 .. Mailed N-400 package via Priority mail with delivery confirmation

06/30/11 .. Package Delivered to Dallas Lockbox

07/06/11 .. Received e-mail notification of application acceptance

07/06/11 .. Check cashed

07/08/11 .. Received NOA letter

07/29/11 .. Received text/e-mail for biometrics notice

08/03/11 .. Received Biometrics letter - scheduled for 8/24/11

08/04/11 .. Walk-in finger prints done.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

So far, we've got health insurance, i'm and excluded driver on the car insurance, i'm the beneficiary on his 401k, i'm on the lease, jointly filed taxes and a ton of family pictures and some from a few trips we've had... I've also got phone records for three months showing primarily his number when i call him at work.....

I'd also throw in any emails/chat logs, letters, flight stubs/more phone bills if available from when you first got together from back as far as when you first got together. This could settle any queries they might have about your relationship being legitimate etc, especially if they could see how you've been together for a number of years.

I don't know the particulars of your relationship, or your husbands previous marriage but I am guessing if they did have any red flags regarding his first marriage and AOS application, it would depend on what ground it was denied back then, so if your husband can be honest with you about it, this might help to put your mind at rest.

We used a law firm to help with out initial filing and to raise some questions regarding our daughter, but they were so expensive I do not think we will ask them to come to our interview, but thats just me. I'm sorry I couldn't be more help!

Timeline

Make sure you know all the details of the old relationship. Especially why their petition was denied. The fact that he has one relationship that didn't end successfully immigration wise means that they will probably look at yours with a fine tooth comb. Collect whatever you can to show public knowledge of your relationship. Photos from parties , things that show you as husband and wife in the company of others. The more occasions the better off you will be.

This will not be over quickly. You will not enjoy this.

I'd say you definitely need a lawyer.

the petition was denied based on them not having enough evidence to show proof of marriage as she moved to a different state because of her job...

After their second interview, more evidence was requested. It was after that the petition was denied...

She left the country when she heard her mother was sick, but all efforts to get in touch with her were fruitless, so hubby withdrew the petition instead of appealing and had a tough time trying to get a divorce from her since she was nowhere to be found... He had to get a divorce in absentia....

But, we have quite a few supporting documents, plus we've been living together for over 8months now. So i'm thinking if anything, we have enough evidence.. the only thing we don't have right now are affidavits from family... I will try to get in touch with a few of them to write some.. If not, we'll just have to keep our fingers crossed and hope our interviewer is calm enough at 8am in the morning since thats our interview time....
