If your USC spouse has residency in Nicaragua, you most probably could file directly at the US consulate there.

What's so very special in your case and why you want to file I-360 instead of I-130?

K3 visa is gone.

When filing DCF, for the affidavit of support you have three options:

- sponsor on assets; if you/ your US spouse have significant assets (property, savings etc), you can use those of the financial sponsorship. Many embassies require these assets to be US based.

- Find a co-sponsor; a US based family member or friend who will stand as guarantoor for the immigrant.

- As soon as the I-130 is filed at the embassy, the US spouse is free to leave the country and return to the USA. They can then find work and provide paystubs and a letter from the employer, as the I-864 support form is only required at interview. However, I would not recommend this option unless you have a good job lined up already, and with a one year old, you probably don;t ant to be apart anyways.

Yeah, we used my husband's sister's address, because we intended staying there a few weeks until our house was ready. Just make sure to submit a change of address if and when you move.

Another questions, do i have to wait for the process ends? Can i submit the I-130 over here, then ask for a tourist visa, go to US and wait over there?

You can apply for a tourist visa, but it may be difficult to get one from your country. If you do do that, make sure you do not overstay in the USA, and have someone at home check your mail in case they send you any paperwork to fill out.
