Thanks HopefulEnd for supporting me like this. I am indeed in lot of mental pressure. Everyday i blame myself and my fate. But then i have decided not to be in any love or marriage once i get out of this. Thus my goal is to get into higher studies and phds. I am trying to take each day at a time and see what happens. I have talked to her and tried make her understand my mental condition.Sometimes she understands sometimes she does`nt. But then i told her that i wd try for sometime to adjust and she will have to try to improve , if not within a specified amount of time, we do have to go for divorce/annulment. And yes i am trying to be more self sufficient and to manage everything b y myself irrespective of her dictatorship attitude.

So how many days in advance , before the conditional GC expiery, i have to apply for the 10 yr unconditional gc ? many thanks.

I'm sorry to hear you're in such a dreadful situation. (F)

You have already received good advice here. No matter which path you choose - removing the conditions with or without your wife, you need to collect every piece of evidence you can to prove a good faith marriage. It helps strengthen your case.

Since your GC expires in March '11, you are eligible to file for RoC 90 days before the expiration date - which makes it sometime in Dec. 2010.

This gives you enough time to decide whether you want to proceed for divorce or not.

As JimVaPhuong has pointed out - divorce before RoC may result in more scrutiny for you.

On the other hand, doing the RoC jointly (and that would require playing nice with her until then, putting up a facade etc.) might bite you sometime later in case you get interviewed and your wife gives you a hard time at that. Plus, suppressing all the anger and pain you feel already will even worsen your state of mind. It would be a living nightmare; you still have got 9 months to go ...

Every day is precious and life is too short to spend even one day in misery.

However you decide, I wish you all the best of luck. Make your decision wisely and not overhasty. You will do the right thing.

Everytime I read in this discussion I get so discusted. All these people claim such extreme abuse even to the point of being a prisoner in their own home yet they are free enough to use the computer to find out how to keep their status.

Please people think about what you are doing. Is a green card so important that you ruin someone elses life and name in the process? If there is abuse call 911 and find a safe place to stay until you either seperate or your spouse agrees to get help.

With all the things you listed this is hardly a case of abuse but more a matter of diffrences that can be settled with simple communication and understanding. But in my opinion, this, like most of the vawa cases in this forum sound more like a abuse of the system.
