remove conditions or naturalization?

hello everybody!

i need some input

my conditional resident card is about to expire october 2010 which means i need to lift my conditions around july

but is it possible for me not to lift my conditions instead go ahead and file for the naturalization w/o first getting my 10 year greencard?

I am presently overseas right now as part of my husband's orders, him being an active duty military

any input will be appreciated

I believe that if she had a conditional greencard she would have only been a LPR for less than 2 years...maybe married for about 2 1/2 years max??

I am under the assumption that you have not been married for 3 years yet....right? Either you or your husband can call the military helpline at 1-877-CIS-4MIL (1-877-247-4645). Since you are overseas, have your husband use the free line to an 800 number from DSN 809-463-3376 (dont dial 1 first..wait for dialtone and dial the military helpline)

Also from the timeline that you have (doesnt tell when you got your visa...but I am assuming late 2007 or early 2008 from your filing date)

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Even if you qualify for naturalization, you still have to file to lift conditions. If your LOC is still pending when the N-400 application is ready to be adjudicated, they may be adjudicated together, but the LOC must be filed.

and i read the new policy it was very helpful

yes we were married for 2 years and 2 months which is less than 3 years so i understand now that i have to lift my conditions

another quick question

it was said on the policy that i have to be 3 years of legal permanent resident before i can apply for naturalization

my question is does my 2 years of being conditional resident count as part of the 3 years LPR status or does the 3 years LPR start when my conditions are lifted?

I have been looking and I have not found anything that excludes a conditional resident from lifting conditions based on an overseas assignment. The I-751 instructions do have specific instructions for those cases, but does not include an exemption from filing.

i will go ahead and file to lift my conditions and just do the naturalization later

a friend of mine just confused me and told me that I should go ahead and file

but with the link that you sent me

it specifically states 3 years of being an LPR and i wouldn't be 3 years til next year

my only concern now is can i be able to apply next year since i will be 3 years of being an LPR or is it until 2013

Your 3 years started with the 2 year conditional residence--it counts.

You will be able to apply next year
