Hi everyone,

It's been a while since I've been here. Last time I posted it was about my fiance's K-1 visa denial. The US consulate officially closed it and sent everything back to USCIS. They claimed it was a sham relationship, which is not true. We gave the required evidence, but it wasn't enough in their eyes.

Rather than wait to make an appeal we've decided to get married in Vietnam and file for a CR-1 visa. I'm already scheduled for a mental test on Feb 22 and then the interview is on the 23rd. I hope everything works out this time.

Is there anybody here have experience with this or give advice to be better prepared?

October 2008 - First visit with Kha in Vietnam

November 2008 - Proposed to Kha

January 2009 - Sent I-129f petition for fiance visa

March 2009 - I-129f approved

July 2009 - Kha has interview (got blue sheet, need more evidence)

September 2009 - Second visit with Kha (Engagement Ceremony)

October 2009 - Kha went to US Consulate (got another blue sheet, denied visa)

December 2009 - Received notice from US Consulate, they sent docs back to USCIS

Are you talking about advice for the mental interview? It was a piece of cake for me... They asked a few questions

1. what is the date?

2. What is my name, age, date of birth, where am I from?

2. What are my parents names?, How old are they?

5. Where are my ancestors from? <--this one was kind of tricky because he heard my accent (I've got an accent like I'm from the Bac apparently) and he kept asking me if my family was from Bac Trung or Nam and I kept saying "Saigon" (it felt like that dannon commercial where the girl is like, I need to have my pants taken in); He got a good laugh out of it, but I passed. :)

Hey my wife got her K-1 denied in 2006 and I start to do CR-1 she also got denied again in Feb 3 2010. Every case is different but this time I am going to visit my wife in April. I hope I can bring her back to USA. The CO give my wife a blue paper and told her next month to submit a time line. It so difficult but I remain commit and love my wife a lot to over come the CO.

My wife was denied a K1 and in December of 2008 our visa was sent back to the USCIS I married her in Feb of 2009 picked up the marrage certficate in April of 2009 and in 51 hours I will be picking her up at the airport because she will have her CR1 visa.

The mental test is nothing to worry about. Just make sure you know enough about her and she knows enough about you to pass the interview. I have never heard of anybody not passing the marriage interview so you should be ok to pass.

The reason I was successfull the second time

1. I followed the info I recived on this board I took note of what worked and what didn't work. I emailed people with questions to find out the reason they failed or passed then made sure I followed what they did or didn't do.

2. I hired Mr Ellis. You can do it without an attorny but he was very helpful for us. I needed a peice of mind knowing he was there in case I had any problems. I did have a few problems and he was able to fix them.

A week after our interview they gave us an appointment date to pick up the marriage certficate and it was a month later. They woudldn't do it any sooner so we told them make it 6 weeks later and I came then to pick it up. If you are lucky you might be able to get it sooner depending on how backed up they are, what office you use, and how much you coffee money you give them but I wouldn't count on it.

To the OP I am in the same boat as you. They denied my fiance's K1 and we decided to get married in Vietnam since we can't do it over in the US. If the mental test you are asking about is for the marriage license is for Vietnam and of course it would be since you are telling us you are getting married here, then it's a piece of cake with general questions being asked. I'm still in Vietnam and will be here till March so pm me if you want to get together and we can share some stories or vent. I am currently in district 5 btw and good luck.

I just came back from Vietnam and will be going back in the middle of March to sign the book and make our marriage official!

The mental test was unbelievably easy. Me and Kha went to a mental hospital just outside of downtown Saigon. It took less then 5 minutes. I just answered some basic question like what's my full name, my parents names, their age, are they still alive, etc...

The next day we went to the Justice Dept and had the interview. At first we we're interviewed separately. Kha went first and answered about 7-8 questions such as, how we first met, how many trips I made here, family members names, age of our parents, our occupation, why we want to get married, how do we communicate, did we have engagement ceremony, our wedding plans. I went afterward and had an interpreter with me and answered the same basic questions. They just wanted to make sure we know each other well enough and have answers that match each others documents. Then we were interviewed together, just to be sure she spoke good enough English. We gave some evidence like my hotel and airline receipts, photos of us together in Vietnam plus our Engagement Ceremony pics.

The interview took about half an hour so it wasn't too bad.
