Affidavit of Support + tax returns?

I would have it on hand - you just never know. I'd hate to see anyone here get delayed because they didn't have it. Our interview was last June, and they asked for three years of tax returns (I sent transcripts to John) and the I-134 on the spot.

Ok, this is weird. Neither myself of my fiancee saw this before (the paragraph about supplying an I-134 and tax return paperwork). Did they just put this in? Maybe they just introduced this requirement, or me AND my fiancee totally missed it!

I learned something about 'checking my prior posts' - many times, there are 'more answers' to questions that I posed.

I can see them (and so can you) by reviewing stuff in the profile, selecting 'view topics' or 'view posts' in the left hand panel. Brings up all of your prior things, plus answers to them.

One would think as a standard precaution the USCIS would SUGGEST somewhere (and not on the embassy website) that you have those documents JUST IN CASE.

On a bright note I had to call the IRS last night, (my return got kicked back last year and I have a whopping $12.51 late fee to pay....LOL) so I ordered copies of 2007-2008, and I will be filing 2009 soon, so that should cover 3 years worth. Incidentally, the told me they would take the whole $12.51 out of my return for this year, but I wonder if that is going to ping immigration as a financial issue. When I talked to the lady last night, she was all don't pay it, we "like to help people out that way" LOL. I told her I didn't think most people would consider that help, but it appealed to my particular sense of laziness. HAHA.

Timeline
Only the single most recent federal income tax return has been required for adjustment of status sine 2006.

Self employed individuals, individuals earning commissions, or contract laborers may need three years to prove income consistency.

And each consulate will do something different regarding federal income tax filings as regards the I134. Since the instructions for the I134 don't specify what constitutes sufficiency of income, the individual consulates are within their authority to establish whatever criteria they see fit.

You probably meant 'affadavit of support', yes? AOS 'meaning', can be tricky, depending on 'where you are' in the process.

Thousands of other K-1 Petitioners SEND IT IN, on a regular basis. The I-134 usually is sent to the Beneficiary by the Petitioner, and the Beneficiary presents it on Interview Day during the interview or to a pre-screener.

If you have personal issues about this (and I totally understand yer concern) - then I strongly suggest you either:

1. make yer OWN SEALED ENVELOPE containing this information, give it to the beneficiary prior to interview day or

2. YOU SHOW UP on interview day, give the I-134 and tax data to your man OUTSIDE the Embassy front door.

1. Is not exactly feasible because sealed or not, if it's lost then it is not like someone else couldn't open it...LOl ;)

2. Would be very nice. I am thinking I would LOVE to try that actually, however, it will depend on what my vacation time looks like around the time he's approved. It would seem I used all my vacation last year going to visit some hot Scottish dude ;).

Are tax returns required and I am overlooking that info? If so, how many years do you have to go back? I think I would only have 2 years of showing where I filed single, and any other papers would involve my ex's income.

What YOU CAN PROVIDE instead of tax returns, is an 'audited and certified' income statement, prepared by a CPA. Figure about 2 hours of his billable time to prepare this. Make sure the CPA includes his attestation and/or stamp on the income statement. Be prepared to get grilled on 'why you didn't supply tax returns' at the interview, but... an Income Statement, of this nature, usually is done to 'show other things besides w-2 income' - for example -

if you have massive assets or

a trust fund or

offshore income or

SSI or Disability Income or

a huge one-time cash disbursement from a lawsuit or lottery winnings.

There are other types of things you can show in an Income Statement - but USUALLY an income statement is prepared IF the 'w-2' or 'taxable income' is questionable, or if the 'taxable income' falls below the poverty line computations.

Simply redact your ex's SSN if that is a sticking point for you. (Though you've already submitted his identifying info with the I-129f. And that will have travelled to the service center, NVC, and embassy.)

Also, you can send the Affidavit of support directly to the embassy/consulate. Other VJ'ers have done so for various reasons. Just be sure that the case file # is on the envelope, documents, etc.

Just keep in mind that the goal here is to secure the visa. Do what it takes to get it promptly so that you can be together with your SO.

I don't mind supplying tax info. I just don't want to supply my ex's Social Security number!

I do not believe the I-129F asked for anything other than "have you been married before and to who, as well as did you go by any other names". They did not ask for his Social Security number, however, I am sure they could find it easy enough. Sending it to the consulate directly if they require it is something I am more willing to do if they require more than two years worth of taxes.

My personal opinion:

This identity-theft/redacting/not-comfortable-sending-info is much ado about nothing.

I'm fairly sure (call me paranoid) that somewhere in a DOS/DHS database/connected-network, everything they ever wanted to know about your Ex is a couple of mouse-clicks away. B-)

I am not worried about the government offices having the information. I am worried about a maid stealing it from a hotel room, or it getting dropped and stolen, or a million other possibilities that could cause the information to get outside a government office. I've had a banking information stolen once...the hassles I went through just to have that stopped took WEEKS. Unfortunately, it's not an unfounded fear. Just think: 1 fraudulent charge = a month or more of clean up while OTHER fraudulent charges went through, as well as having to sign affavdavits left and right that "I" didn't do it, on top of getting fradulent charges reversed and wondering if the ####### was ever going to stop, so I COULD close out the account and get a new one. It was a nightmare...so yes, I am beyond paranoid about it.

I can certainly understand that - as Anh map pointed out - London (and I presume others) has posted instructions that allow you to send this information to them directly. DHL (another fine German company by the way) deliverers packages all over the world to DOS locations (Embassies/Consulates etc) every day (very likely that is how NVC sent your petition to them, for example). One way to avoid the maid from getting his/her sticky fingers on it. :star:

hmmmm. There have been 'blue slips' on interview day at the consulate in GUZ for the beneficiary NOT supplying the prior spouse's ssn and contact info. but it's not 'gospel' - ie - every one who not supply it got dinged for it - not at all.

At some point, you are to supply divorce decree on prior spouse(s), which USUALLY will have the SSN of the prior spouse (this varies by court and jurisdiction).

At some point, you are to supply divorce decree on prior spouse(s), which USUALLY will have the SSN of the prior spouse (this varies by court and jurisdiction).

It is supplied with the initial I-129F filing. I have already sent it to them. I don't remember off of the top of my head if it had it in there or not. I don't go back and study it over and over...LOL. Maybe it's in there. I think shipping the information directly to the embassy is the best way to handle it. I don't have to worry about sticky fingers or a denial. I already ordered the tax statement, so I'll have those in the next 2-3 weeks. I just have to file my taxes for this year, and all will be good to go!
