Hello my friends. First of all I'm not sure if I'm posting this in the right section so my apologies if I did wrong.

The past week Corina's mother died. Cory still doesn't have the AP approved so she could not travel. Needless to say she feels very bad about it so please bear with us in this hard moment.

She is the only daughter....meaning she has no brothers or sisters, only one aunt and one cousin who live far away from her father. Now he is alone. By the way....he is 59 years old and close to retire. Corina is planning to bring him to USA in the future God willing but we have barely started the AOS process so this is far from becoming a reality anytime soon.

My question is.....what is the possibility of a B2 visa for her father? I know that we have the option of visiting him but it would be good if at least we could alternate the visits with him coming here. Corina is his only emotional support and vice versa so it will mean a lot to her if they could see each other often.

Thanks in advance for your help and please I beg you......hold the off color commentaries. The situation is bad enough as it is.

January 25, 2010 - Cory received her SSN

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved

Her father has a 50/50 chance of getting a tourist visa but that should not keep him from not trying. He should take as much evidence as possible to prove any ties he has to his country, that way the CO will feel better about his reasons to come back after his trip. He can show bank statements, property deeds, or any other evidence he can think of.

The father will have to apply for his tourist visa. What you can do is send a letter of invitation stating for how long you are inviting him to come, what expenses you will cover (ticket, room and board...)

If you have sent in the AOS, you can make an INFOPASS and request an emergency AP - they will stamp the passport. They were made for cases such as this.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Our sincere condoleances to your family, Your father in law can take a chance, usually the older folks stand a better chance to get tourist visas than younger ones as the possibility they will remain in the US is less likely than at a younger age. and like the previous post if you have already submitted your AOS papework you can try the infopass and see what happened.

Brother Bobby is right on the mark. Make the InfoPass and hopefully she will have it and be able to travel back.
