Hi folks. I just have a few questions to ask in regards to the K-3 visa. I am about to file but i want to make sure i have all my ducks in a row first. So here are my questions / Issues

1) We have a joint account. However it is NOT in the United States. We established it in Canada when i was visiting so that i could wire funds for her and my son when i had the chance. Is that alright still for proof of commingling assets?

2) Should i get sworn statements from family and friends to include with the package and if so what exactly makes a statement sworn? Do they need to be notarized? Etc?

3) I have spent the majority of the time we were married unemployed. My main concentration since i was young has been manufacturing and here in NC there were precious few jobs to find. I am however working now, I have been for the last three months and i make enough for a family of three at 125% of the poverty guidelines. Is that enough or should i begin looking for a co-sponsor

Basically i am looking for everything and anything i can do / include to insure things go as smoothly as possible. I haven't been able to afford the paperwork till now, and as a result of my inability to find work i have been separated from my wife and son for over a year. I really don't want anymore complications if i can avoid them. The paperwork itself is straightforward enough. I am just looking for what to send in addition, what else could help my case, what else can I do?

Dont worry much.... the line that says "wife and son" will take you to the finish line. Just keep records of communicating and child support. If you make the 125% poverty guidline for a family of 3, then you do not need a co-sponsor. Best of luck

The K3 visa is no longer available since 02/01/10

Instead you can apply for a CR1 visa.

Never mind I found the information, It states however that it is for cases where the I-130 and I129F are received together and the I-130 has been approved. My understanding was that filing for a K3 was only done when a I-130 was pending anyway as evidenced by the need to send the NOA's out. Please do correct me if i am wrong, as i don't want to make any avoidable mistakes

I am also getting ready to file for spouse visa. A little confused as to wether I should file the K3 or CR-1..... actually both of these confuse me. She also has a son that will follow entry to the US at another time, probably a few months later.... suggestions?

Where does your wife live in Canada? If it's East of Manitoba, her interview will be in Montreal, and you won't get an interview any faster for a K-3 than a CR-1. A CR-1 will enable her to get a GC as soon as she arrives in the U.S., and you wont' have to adjust status. Just wondering if you're going for the K-3, because she is interviewing in Vancouver? That's the only reason I'd think you'd want to proceed with a K-3.

When both are filed, the I-130 and the I-129F are being approved on the same day. When both petitions get sent to NVC, NVC will now cancel the I-129F is there is an approved I-130. It is unlikely you will interview anywhere else other than Montreal due to the new procedures. I do not believe much of a choice as to which visa to follow are afforded to you any longer.

Pursue the I-130 solely, it is a superior visa anyway

Hi.. I just wanna ask about the Tax, since my husband didnt know at first about the TIN of me, is it ok that he didnt add me yet on his Tax? Is this also Ok from NVC? Is this really needed or important that I have to be added on his tax? Hope to hear from you...thanks

MY INTERVIEW DATE IS JULY 8,2010 at 8:30AM but WE NEED TO RESCHEDULE FOR AUGUST!
