My husband has been abusing me physically, mentally, and emotionally.

I have all the documents that support that I am being abused. 3 police reports, reports signed by the coroner and I have also certification from the Shelter for women where I stayed for protection. I am staying now with my cousin and we are not yet divorced.

My question is,

Can I remove condition alone?

What should I begin doing from here?

How to Get a Waiver of the Requirement to File a Joint Petition

If you are unable to apply with your spouse to remove the conditions on your residence, you may request a waiver of the joint filing requirement. You may request consideration of more than one waiver provision at a time.

You may request a waiver of the joint petitioning requirements if:

Your deportation or removal would result in extreme hardship

You entered into your marriage in good faith, and not to evade immigration laws, but the marriage ended by annulment or divorce, and you were not at fault in failing to file a timely petition

You entered into your marriage in good faith, and not to evade immigration laws, but during the marriage you or your child were battered by, or subjected to extreme cruelty committed by your U.S. citizen or permanent resident spouse, and you were not at fault in failing to file a joint petition

What are the fees if I will apply for a waiver? or remove conditions on my own? I don't have my income.

Then you would need to apply for a waiver of the fees.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi, I am pretty much in the same situation. What did you do , could you remove the conditions alone...

K1 VISA

May 23, 2007 - I-129F mailed to NSC

June 05, 2007 - I-129F recevied at NSC

June 07,2007 - Check Cashed

June 13, 2007 - Touched

September 18, 2007 - Touched

September 19, 2007 - Touched

September 21, 2007 - NOA 1 Hard Copy by mail

October 25 - Aproved!!! NOA2 sent by mail

October 29 - NOA 2 Hard Copy rcvd by mail

November 28 - Letter from NVC, advising that is sending case to Brazil in 1 week

February 2008- enterview in RJ

March 12, 2008 - arrived in US

April 26, 2008 - Marriage

AOS

July 18, 2008 - Sent AOS documents

July 29 - Money Orders cashed

August 1, 2008 - Notification of Action from USCIS

August 21, 2008 - Biometrics

October 14, 2008 - Work Authorization Card in the mail

January 17, 2009 - RFE

January 30, 2009 - Sent Documents Requested on RFE

February 04, 2009 - Response to request for evidence received, and case processing has resumed

February 06,2009 - Card production ordered

February 10, 2009 - Approval Notice sent by mail!
