Hi,

I'm new on this website and I heard alot of good things about it. You've once helped my aunt to obtain her visa. Hope you can help me too.

I have a current B1/B2 visa and I am already in the US, I found an employer already who is willing to sponsor me. How will I convert my tourist visa to working visa as my employer wants me to help them in filling the application as it is their first time to encounter this situation. How long does the normal process take to convert my status. I only have 3months to go before my visit visa expires. I hope you can help me on this. Do you have any idea of what form should my employer use and other documents needed. And what do I need to prepare for my requirements.

I believe you will have to file for a change of status. The H1b visa cap has already been reached and the issue right now would be what status will you hold until the H1b is valid again (is it October???). If your employer is willing to wait until October (or whenever), then you can go home and fix everything from your home country. There's a risk involved (e.g the USEM in your home country won't approve your visa), but having your visa stamped from there has its advantages as opposed to changing your status from here - - you can travel in and out of the U.S.

I suggest you consult with an immigration lawyer regarding your case. My cousin exactly the same dilemma years ago and in the end, she just went home because the employer wasn't as willing as she thought they would be (their financial documents will be scrutinized).

A work visa is a H-1 visa which is employer sponsored. It would have to be a "real job" not just some menial work and all of the visa paperwork will be done by them, NOT you.

And I'm not sure you can really convert a B-2 into a H-1. I'm sure someone else will come along and add something to this.

As a previous poster mentioned, not all jobs qualify for a work visa, and it can be difficult for the employer to be "allowed" a work visa- they must prove no American can/ is willing to do the job. Also, there are different kinds of work visas, depending on the type and length of work (managerial, religious, highly skilled etc). What type of job have you been offered? Once we know that, we may be able to help more.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Unless you have an educational background above the Bachelor's, i.e., a Master's or Doctorate degree, you can't adjust status. If you do, the employer has to go through the process of labor certification, which takes about 6 to 8 months, and they have to prove that nobody in the US is qualified and able to do what you do at a fair pay. The last part is actually fairly easily by posting an ad to which nobody qualified responds, yet it still is an involved process.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . .
