I think the ITIN sound's interesting and would like to get one for my husband. How do I go about getting one? Anybody with knowledge pls advise. We are getting important documents ready for interview in advance. My bank had also refused to add him but who knows if I can still add him after getting an ITIN.

the form you need is a W-7 from the IRS. From reading about it, you will have to paper file your taxes this year and send the w-7 in with your 1040. According to the form, you have to submit it with your tax return.....so no electronic filing unless you want to file an ammended tax return later

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Scott's nailed it, in one.

The only way to get an ITIN for your spouse is to file a joint 1040, paper version, with the W-7, to the special W7 address in Austin, TX.

There are documentary rules for HER ID - pay particular attention to those - as they changed (in 2008 ? ) - so it's a bit harder these days .

The bank's unwillingness to 'add your spouse' comes about from The Patriot Act - most banks claim the spouse has to be in front of a bank employee. It won't matter if your spouse has an ITIN or not. What matters is 'physical presence'.

BUT - you can take a copy of the marriage certificate (translated to English) and a copy of her Chilean Passport, and have POD (payable upon death) instructions added on all of your bank accounts, CDs, financial instruments. Include those for interview day (but was better to submit them on initial I-130 'send off', instead)

Here is how you can get it done...

IRS has stopped issuing ITIN numbers beforehand.. but you can still file Jointly

You will need to mail in your tax papers or hand deliver @ local IRS office... cannot do the e-file thing.

1) Perpare TAX , your status as Married Filing Jointly (PAPER COPY).. Applied for ITIN where SSN/ITIN number is asked.

2) Fill in the W7 form

3) Attach a Attested(Notarized) copy of your husbands Passport.

4) Notarized Copy of your Marriage Certificate

5) Walk into local IRS office and hand deliver your papers or Mail the forms to IRS

IRS Will veruify your documents and then Give an ITIN number.

** I'm Not a lawyer... only giving you rough idea on what can be done. pls talk to your accountant or Lawyer for all details. I'm sure about filing as "Married filing Jointly" thing... casue i went to Local IRS office and thats where i got this info from.

2009-11-23 NOA1.

2010-02-25 NOA2.

This is my understanding of getting an ITIN for an alien spouse. You fill out your taxes on paper (you cannot e-file) and you file married filing jointly and where it asks for the SSN for your spouse, you write down requesting ITIN for spouse and attached an IRS form W-7 which is basically an application for an ITIN. You can get the form from IRS's website. Attach them and mail it in. But word of caution, this is supposed to take anywhere between 6 to 8 weeks,possibly more. I am in the same situation and have decided to send in my taxes for 08,07 and 06 and have my tax return statement for 2009 ready for the interview but only file as single.

Hope this helps you make a decision.

I just got an RFE from NVC operator (no email yet)..

saying line 10 in I-864A was filled incorrectly.

1. Can you mail the missing part BEFORE receving the actual RFE email since it was explained by the operator?

2. The operator says re-send I-864A and fill line 10 correctly. Get line-10 information from W-2 line 1 or 3.

Does anybody has an advice re: filling the correct information re: line 10 in I-864A ! The thing that really surprising , the NVC operator says get the information from W-2 line 1 or 3 .. However, we have mailed the NVC the W-2 with AOS packet!!

Timeline :

USCIS Journey

MAY 21 09 : Application I-130 sent LPR

OCT 18 09: Spouse became USC

JAN 22 10: USCIS Online status showed I-130 APPROVED!!

NVC Journey:

JAN 28 10: Case received by NVC & number generated

MAR 31 10: SIGN-IN FAILED!

APR 14 10: Interview assigned

Medical APR 22 10 - DONE

Interview MAY 11 10

Visa Received MAY 25 10 - VISA RECEIVED - Alhamdulellah -

POE MAY 29 10 @ JFK

SSN JUN 15 10 (applied for replacement)

SSN received JUN 22 10 received! "unrestricted employment"

GC Received JUL 12 10 GC RECEIVED

US Citzenship MAR -- 13 xxxxxxx
