I-134 POVERTY GUIDELINES?

Hello all,

I was just wondering if the same poverty guidelines used for the I-864 apply to the I-134. I´m a little nervous about filing my affidavit of support because I spent about half the year living with my husband in Colombia and was unable to work because I had a spouse visa. My income was significantly less than normal because of this and I don´t want it to jeopardize our chances.

Any kind of help would be great. Thanks!

Yes - most all Embassies/Consulates base their decicions on guidelines found on the I-864's instructions (or in relation to it); the poverty guideline minimums are for sure.

This is from the instructions on the I-864 (you can use these numbers as a reference; 100% for active-duty military or 125% for everyone else).

Keep in mind that what really matters is how much you make now and going forward, not how much you made in the last year. So even though your tax filings may put you under the poverty threshold because you only worked for half a year, if you can provide recent paystubs and a letter from your employer stating you are a permanent employee and how mcuh you make every week/ month, you should be ok.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
