Bob 4 Anna I seriously don't know where the hell you are getting off, so why don't you just back off as well.

Please be a little more coherent in your replies and I'll try to address them completely (as I have previously).

What have I said that is confusing or offensive to you?

Is it that hard to believe that everyone here is reading the same thing from your posts?

Do you really think that USCIS employees who are practically mandated to assume there are issues with your petition will overlook what is so obvious to everyone here?

I took the time to type out a well meaning PM to you, said nothing disparaging to you and even offered what I honestly believe to be your best chance of getting your girlfriend to the US within the laws that govern Immigration to the US. How to you reply, "Go SPAM someone else"? Classy, intelligent and well constructed response...

And let this be a lesson to you and all reading that PM's shouldn't be interchanged for the purpose of offering immigration advice. Better to keep it all on the boards where constructive discussion can be had; mistakes can be caught; and good advice archived for posterity. Protects the community and individuals from liability as well.

I don't see anything constructive in what those of you are saying in that it's clearly assumption. Regardless how I try to stay on track, making a mess out of what they feel I'm intending to speak of.

Getting angry at people who have good intentions and have tried their best to offer solid advice won't help you achieve your goals. I'm not in your shoes, but I can empathize with the prospects you'll be facing.

No one here is trying to dash your hopes, but one thing I've found in my almost 2 years on this forum is that we're realists and offer advice as we would to a friend. That's been done. What you choose to do with this advice is up to you. Why you, with 4 days experience here would begrudge people who have your best interests at heart is beyond me. Everyone has gladly given of their time and knowledge to try and answer what you've asked and you'll either heed what we've said or not.

Bottom line is that you should file your petition, attempt to gain your waiver and let the chips fall where they may. Either way, you'll know is about 6 months.

Shane you have your answer. The only other thing I can think of that you may want from here is an outline of the letter explaining why it is impossible for you to meet with your fiance. No one here can write the letter for you although we have told you what the letter must contain. To summarize

1. The reason why you cannot travel to any country in the world to meet your fiance and/or why she cannot travel to any country in the world to meet with you. For example why you and/or her could not meet in her country, Mexico, Canada, or any of the other hundreds of countries in the world at any time during your lives.

This must be supported by evidence for example a notarized letter from your doctor explaining your condition and why you cannot (not just difficult but cannot) travel in any way (boat, plane, train, bus, etc.) to any other country. AND

proof that your fiance cannot obtain a visa/travel to some country to meet with you, for example as previously stated a record (not just one time) of denial of a tourist visa.

Lack of money is not grounds to waive the 2 year requirement. You must prove that it is impossible for you and her to meet.

Send the letter along with all the evidence when you file the petition for the K-1 visa.

The question(s) have been addressed and answered in multiple ways - to pursue an aggressive stance against folks looking out for a stranger's best interest makes me question the validity of the thread. Good luck on your journey. :thumbs:

I'm not saying I'm definitely trying for the hardship so no I'm not looking for an outline or have I asked, it was a simple question of context. Clearly if part of the context is that for reasons we both can't travel then that's as far as my answer will get me. I'm not getting aggressive, but I am defending myself from pretentiousness. And I thank you all for entertaining the subject further.

Shane - Immigration forums are full of inspirational stories.

There was one in this community some years ago of a young couple both stricken with muscular dystrophy.

She made the requisite trip to the US for purpose of meeting and found their love was real. He filed a petition on her behalf to move to the US. Their disabilities were fully disclosed along the way, including affidavits of support by other parties for the financial aspects of grant of a visa. She subsequently moved to the US and to my knowledge they both still reside here, both being cared for by his family members and other respite workers.

Our journey together on this earth has come to an end.

I will see you one day again, my love.

Thanks for sharing JohnnyQuest. After I make my decision and all I'll come back and share the results. I may decide to see if we can meet in a 3rd country first and If not, I'll see if family will shoulder the loan for meeting however difficult it may be. Hardship is not an option as you would like to believe. You either need a hardship waiver or you don't, in which case, you would not need to enquire about it. Not wanting to travel or travelling being an inconvenience is no basis for a waiver. Whatever your reasons to not travel till now do not sound like they will qualify you for a waiver. The question is -

Are you incapacitated to qualify to apply for a waiver? If not then its not an option and a visit to the Phillipines is your only option.
