Hi to all!

First of all Happy Valentines day to all! (L)(L)(L)(L)(F) me and my wife are planning to go back to Philippines this coming october for our church wedding.Now one of the requirements is to get LEGAL CAPACITY TO MARRY.so here is my question.should i call USEM for Appointment or just walk in.?

And how many days it will take to get that Legal Capacity to marry?

I really need your advices here..i want to get it as early as i can..

March 11,2010-----------for my AOS..and always checking our mailbox..hehehe

March 10,2010------------Interview for my AOS @ 9am (done) and waiting for the result.. whew...

March 22,2010------------Received my Greencard!so happy!

no appointment needed they are open 7 to 10am only for those who's getting a LEGAL CAPACITY TO MARRY

If you are already married and just having a church wedding in the Philippines for your family, you won't need any papers. Your US ceremony is recognized by the Philippine government so just have a nice church wedding and don't worry about the paperwork.

(you did say your WIFE and you were going back to the Philippines for a church wedding)

USEM will not give them LCM they are married :blink:

They will if he lies under oath...

No I am not recommending he lie...

As they are already married the "Church Wedding" is not a legal wedding therefore no such documentation is required. There is no need for a Philippine Marriage Contract and in fact both parties would have to lie again to the civil registrar as neither is legally able to enter into marriage whilst legally married.

Don't over complicate things, the "Wedding Ceremony" doesn't require any legal documentation.

Thanks for the reply.That is what i thought also since we are already married here in the U.S. but since my wife ask her mom to ask the requirements for church and civil registrar.

WIFE'S REQUIREMENTS:

Birth certificate from NSO

CENOMAR

MINE:

Birth certificate

Passport

Divorce decree

Legal capacity to marry

CENOMAR (they said i need to get cenomar also in PH) reason:to know if i was married to a filipina before or not//(what a %%%)

and last our MARRIAGE CERTIFICATE.

So now im confused some say i dont need and some say USEM wont issue LCM coz were already married.

You might want to rethink this, a bit.

Yer married. It's Global.

But you can have a really nice 'marriage re-affirmation' ceremony. If the 'wedding' is to be at a Catholic Church - ask the mother to ask the rector/priest exactly what that looks like.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

everyone is correct, you are already married, so you cant get a LCM...

But now if your wife wants to get her married name in her passport, she just needs to report her marriage abroad at the DFA.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

City of Butuan is requiring me to get a Cenomar for our wedding. One of the reason might be according to my future brother in-law

who is a supervisor for NSO in Cebu is that there have been cases where Americans have come repeatedly to Philippines marrying Filipinas.

okay,i may try to talk again with my mom n law..about this things..

As of now she was thinking to renew her passport to PH this coming october..but can't change to married name coz we already purchase a ticket and using her last name before.

We're also having a Catholic wedding in the Philippines in May and we were only asked to submit marriage certificate in lieu of the LCM. My husband was not required to get a CENOMAR. Are you both Catholics? As far as I know there are other church requirements you need to comply with such as the following:

1) Baptismal Certificate and Confirmation Certificate with notation "for marriage purposes"

2) Certification of freedom to marry from the parish priest

3) Pre-Cana seminar certificate

The 3 additional requirements above are for couples who are both Catholics and both single never-been-married. You may want to ask your mother-in-law to check with the church about specific requirements. Note that there may be other requirements if you're not getting married in her parish.
