Hi all,

One of my friend's is filling for I-130. This is what happened.

His wife's Indian Passport is expired, so she made her new passport with husband's middle and last name.

Question:

Does he need to send any documentation stating the name change for his wife while filling I-130?

Because I read something on USCIS website asking to submit document regarding name change.

Immediate help is really appreciated.

Thank you. :star:

So he submitted the I-130 in her maiden name? Hmmm...i never gave it much thought, (we submitted in married name and just renewed my wife's passport to her married name) but the marriage certificate will be enough for a name change without having to go to the courts and the pain of that.

There may be different requirements for india that I am not aware of. There will be someone with experience in this for your country soon.

We submitted the petition in my married name - all correspondence that has been received from NVC has been addressed with my maiden name, if I could ever get through to an operator I would like it changed before I submit the DS-230.

You can call USCIS and ask them to change your wife's name to her married name.

The marriage certificate and new passport should be enough.

No, he submitted the I-130 with his middle and last name. But he changed his wife's name to his middle and last name. Anyways, I don't think there is anything to be submitted as a proof for that because I-130 package include marriage certificate and I think that's enough as you mentioned. Also, he sent marriage photos just to prove the bone filde marriage.

Thanks for the help.

You can call USCIS and ask them to change your wife's name to her married name.

The marriage certificate and new passport should be enough.

I think so too. thanks.

Wow, I'm looking at your timeline, you are working very fast. Good for you. Good luck with everything.
