Hello, I really need your advice,

I am a Japanese female who married to a US citizen.

My husband filed i-130(NOA! 9/28/2009) for me and K3(NOA1 10/19/2009).

The reason why he filed both is just because of my 2 teenaged children. We haven't filed I-130 for each child yet.

We got I-130 approved on this Feb 12 by e-mail.

we checked the status for K3 on line but it says still pending and nothing has changed. Only I-130 status was renewed.

According to latest News, even if both approved at the same time, K3 will be ends.

Then what should I do?

I will do I-130 paperwork for my children as soon as possible. But I don't know how long it will take.

My I-130 took almost 5 months to get approved. I am worried a lot.

We don't hire any immigrant lawyers.

My husband's idea is applying student visa for them. I'm not sure. Is it still possible for them to get student visa?

or does anyone know how to let our K3 petition still available after I-130 approved prior?

I'll be very appreciated.

Thank you.

there are a coupla options - but for I-130 child (CR-2 derivative status) all ends when the child is either 18 or 21 (sorry, can't remember which age top - I-130 is one thing, K-3 is different).

1. File new I-130 petitions on the children, NOW. or

2. File new I-130 petitions on the children, after YOU arrive in the USA.

Don't worry about the timing for the 3 interviews (yours and your children) - as YOU CAN reschedule the interview date (once you've received one) via email contact with the Embassy, to match the dates for your children.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
