I am new to this and looking for advice or people who can help me I am a American citizen who married a Mexican who ewi over then years ago we have been married for 5 years and have 2 kids together he has never been caught by immigration nor ever been in trouble with the law we are ready to start his process on getting a green card I know I need to file the I130 but whats next?? PLEASE HELP AND THANKS IN ADVANCE

I don't have any experience with EWI or from filing from within the United States. There is probably a forum thread that is more appropriate for that. Most people on this thread have filed from inside Mexico via a process called Direct Consular Filing (DCF), which is explained here: http://www.visajourney.com/content/dcf

The process is only valid if you are living overseas.

September 5: GREENCARD APPROVED!!!!! Currently awaiting package from DHL

no i dont live in mexico. my parents and sister do. so how is the process, my sister is 17 years old. will she be included in my mothers app

I only know the DCF process, in which the first step is that you need to bring the completed I-130 packet (with all necessary supporting documents) to the embassy here in Mexico.

While it looks as if this topic is not very active, I'll throw my two cents in so that anyone following us can have updated information.

I am an American citizen who has been living in Mexico for the past 10 years. Three years ago, I married a Filipina woman and brought her and her son to live with me here. Just recently, we increased the size of our family with my wife giving birth to another son. Earlier this year, we decided to move back to the U.S. - well back for me as my wife and stepson have not lived permanently in the U.S. Last Thursday, we set up an appointment at the U.S. Embassy in Mexico City to register the newborn as a U.S. citizen. After we were done, we stopped off at the USCIS office in the embassy to start the paperwork for permanent resident visas to the U.S. (Our youngest son is actually a triple citizen - U.S., Philippines and Mexico. After we finished up at the U.S. Embassy, we walked over to the Philippine Embassy and registered him as a citizen there as well.) Our experience at the U.S. Embassy was, by and large, a good one - outside of the long wait to complete the CRBA. The baby was declared a U.S. citizen and we filed for his passport which should arrive by the end of January.

Our visit to USCIS was also pleasant. Although the Embassy website says that no appointment is necessary, the lady behind the window said that we should have had one. She was very kind and helped saying something to the effect of "well, you're here already so let's go over everything." We dropped off all the paperwork and she went through all of the original documents that we had brought to verify that they were true copies. In addition to the I-130s for both my wife and stepson, we delivered I-325a for the three of us, included a passport sized picture of each of us, copies of our passports, Mexican visas, birth certificates and our marriage certificate.

After we finished with the paperwork, she told us that the length of the process is currently running from 6 - 8 months (although recent posts here indicate that visas are being processed much quicker than that here in Mexico.) She also told us that approval paperwork would be sent to our Mexican mailing address. I asked if there was a means of being notified electronically via email as the Mexican postal system is inefficient at best and she supplied a form through which I could supply my email address and telephone number to be notified.

All of this took place last Thursday, December 18. Today, I received notification by email that the Embassy has approved the request for both my wife and stepson and were forwarding the information to the consulate in Juarez. They also included a link where we could inquire in Juarez for further information. The information contained scanned PDF copies of the approval letters, which were password protected. The password was sent in a follow-up email a couple seconds later. So, basically the Embassy approved the request in 2 working days. That's not bad at all. I'll give it a month and make inquiries at the consulate in Juarez about the next steps of the process.

If you are planning to start the DCF process, I highly recommend that you take a trip to the Embassy and deliver the paperwork personally. The process was fast, efficient and the personnel friendly, plus I had the satisfaction of knowing that they had everything that they needed.

Thank you for posting. I am the one who originally started this thread and although I haven't been very active on it (never actually went through with the visa journey), I do keep tabs on what everyone is posting. Thanks for your current input. And good luck on your journey!

Hey everyone, I want to go the DCF route for my husband, we both live and work in Mexico, I became a naturalized MX citizen about 10 years ago so I don't need a FM2 or FM3 form, would this be held against me if I file for DCF?

Another update on our progress in the DFC realm. About a week and half ago, I emailed the Consulate in Juarez to get case numbers for my wife and stepson. Today, I finally received a response via email from them. In their response, they indicated that they had mailed us the case numbers on January 2 (obviously, they haven't arrived yet), but included the case numbers for both and a PDF copy of the letter they sent. So, I began working this evening to fill out the online DS-260 form. You can find that webpage at this link https://ceac.state.gov/IV/Login.aspx . The process is fairly straight-forward - if you have all of your relevant documents available - and I was able to enter in the information for both in about an hour. (My stepson's application went significantly faster than my wife's as I used her's as a template.) The only fly-in-the-ointment is that we are unable to electronically sign my stepson's application. I'll try clearing the browser's cache and doing it later or we'll wait until morning to see if it goes through.

I guess the next step is to put together all of the documentation to send to Juarez. That shouldn't be hard as we have most of it all available from filling out the DS-260. The financial forms will be the biggest step. I do not anticipate problems with the financial qualifications even though we've lived here for the past 10 years and I have no appreciable income to show from the U.S. as my parents are acting as co-sponsors. We are hoping to be able to schedule interviews during Semana Santa to avoid having to spend a lot of time out of work. We'll let you know more as details become available.

BTW, we received my husband's official plastic Greencard last week, just a little over a month after entering the US with his temporary passport stamp. They said it would be 3-6 months!

Hi Marisol. I am Idalia and my husband Eric is American. He has been in Saltillo with me for a year. We filed I-130 on Oct 9 last year. In the G-325A form we stated he lived here in Mexico, but in the I-130 wrote my host parents address in Santa Fe, NM as "address you are going to live in USA".

On Oct 14, 2014 we got an email from Monterrey consulate saying the I-130 was approved and two months later a letter saying the same.

On Nov, a letter addressed to my husband was delivered in my host parents house saying I could schedule an appointment in Ciudad Juarez consulate on any available date.

On Dic, we got the same letter addressed to me in our house in Mexico.

We have been postponing the scheduling of the interview because my husband's work permission in Mexico has taken forever and the plan was he would work here and both are going to leave to USA together. Also for medical reasons, in Mexico some, medical stuff are cheaper.

So we are still reading and checking when we should schedule the interview.

I am american citizen by naturalization (and mexican by birth).. I have lived in mexico for the past 3 years. I want to return to USA with my husband and baby(mexicans). I dint now about DCF until a few days ago by this site.

I wll try to do a DCF, this thursday I have an appoinment in US Embassy in Monterrey, Nuevo Leon because i have so many questions !!.

1)we must go to ciudad juarez or they do the process in monterrey?. I hope we dont have to travel to cd juarez. 2)I will need a sponsor because i dont have a US income.. Can I use a sponsor?..

You can file the I-130 in Monterrey, but the process for the immigrant visa will be done in Ciudad Juarez consulate as it is the only one in Mexico to process those kind of visas.

3)In the web page of the embassy says that the DFC can be filed there if the american citizen has a FM2 or FM3 mexican immigration permits (but becasue i am mexican by birth I do not need them,, so i dont have them)

The American citizen has to have a legal status in Mexico to file DFC. So I guess you are OK showing your IFE card or birth certificate.

4) How long time takes the process

Our I-130 was approved after a week and a month or so we got a letter in Santa Fe, NM, USA addressed to my husband and a month later the same letter addressed to me in our house in Saltillo, Mexico. The letter said I can schedule an interview on any available date.
