quick question - i am still living in mexico with my husband, and hope to until he is approved so we can both move together. we plan to live with my parents when we go to the US. that is my domicile - my driver's license address, bank and credit card statement address, etc... HOWEVER, i believe i will be officially unemployed while filling out the paperwork, because my income in Mexico won't count... and it's less than what is required to file US taxes, so i haven't filed taxes since tax year 2008. i thought my dad could just simply fill out the I-864a because we will be part of his household, but i'm not sure if him doing a joint sponsorship I-864 is better??? also, my mom doesn't have any income but is listed on his tax forms... will i need to do something with her as well??

i'm so confused! thanks for any advice you can give!

I just wrote a reply to your post and, since my internet connection is not very strong, it deleted! HAG! Let's try again and this time I'll copy it so I don't lose it.

If I'm not mistaken, you and your dad MUST file joint I-864 forms. You should file because you are the petitioner (even if you don't make enough to qualify as your husband's financial sponsor), and your dad should file as his legal economic sponsor. I didn't make enough in Mexico to actually pay taxes in the US for three years from 2009-2011 but I filed anyway to legally show that I am an invested American (to show that I was still doing my American duties, even living abroad). I filed late, but I filed. As far as your question about your mom, I think what my dad did was only site his income on the I-864 form. My mom earns an income as well, but my dad qualified as sponsor without her income so we thought it best to leave her out of it and keep it simpler. I hope that helps. My husband was approved for his green card in December, and I was then when you are now! Keep pushing through it!! Good luck and if I can help you further let me know.

thanks sooooo much, osos!!! we will do that, then. i was confused because we'll be in the same household, so i didn't know if i just needed to do the i-864 and him the i-864a or what. i don't know why they don't make it clearer! anyway, i'll take your advice and we will both do the i-864 forms since that worked for you! thanks again!!!

Hi Guadmom,

Thank you for this information. I am a little confused because the website for the Mexico City Field Office states:

"Form I-130

United States citizens who reside in Mexico with Migration Form (FM) - 2 or 3 may file a Petition for Alien Relative (Form I-130) at the Mexico City District Office by mail or in person during normal business hours."

When did you receive the email from USCIS?

I am not sure what you are confused about??? From my understanding you file at the Mexico city field office since you reside in BC. My email was from January. If I remember right, you said you had an FM2 or FM3 so you should be fine. I hope that helps.

I just got my NOA1 which baisically says uuuh nothing. Any tips on what to do next or how long I need to wait for another letter or something. I don't want to waste time and the letter doesn't tell you what to do other than...we will be in touch basically.

One idea that I would say is to start working on your I-864 form(s). That's what I did while I was waiting and waiting and waiting. Good luck!

Hi sarashell, like osos says, get started on the forms and getting everything together. You'll need everything that it says to get together from packets 3 and 4 - the info is on Ciudad Juarez Consulate

I received my letter and my husband received his letter with instructions on the same day, so I suggest if you don't get the other letter soon, try calling the conuslate to ask about your case number and the next steps (it's possible the other letter was lost in the mail). The phone number on my letter says (656)227-3000, in case you don't have it.

Uff... I don't have my copies of the I-864's that my father (co-sponsor) and I did to reference right now. I'm pretty sure that I just claimed my husband and I and my dad claimed my mom, himself, my husband and I. Could you call the Call Center in Juarez and ask? I would guess that you should claim 2 and your dad should claim 4...

I'm just going to go with me claiming just 2 in our household, and my dad will claim 4 - my husband and I and my mom and dad...

Hi sarashell,

If the Embassy needs something additional they will contact you by mail to request the missing documents. Unless something changes, the next step is a packet that you will need to send to Cuidad Juarez. I think they call it Packet 3 or Packet 4 something like that. It incluedes the I-864 packet. After that packet is received and approved, you should not have to send anything else.
