Hello,

My fiancee and I will be getting married in Texas in May. After that I plan to go the I-130/CR-1 route so that she can legally move to Texas to live and work. From reading the guides, FAQs and posts on this site, I believe this is the best option for us or at least it appears to be the most efficient route.

After the May wedding we plan to go to India for the ethnic ceremony. She'll be going in June (from Canada) and me in July (from the US). Both of us will be returning mid-August (again, her to Canada, me to the US). The question is, is this possible? Will she need to remain in Canada during the entire process in order to respond to correspondence? I don't want her to miss out on responding to anything she might be sent regarding her immigration because she's in India and causing rejection or needing to start the process all over. If that is the case we're willing to start the process in August after our return from India.

Please advise. Thank you.

No - from your timeline it sounds like she'll be fine. If you marry in May and she doesn't return to Canada until August that should be fine. If by chance your petition is approved while she is in India, many steps taken at NVC can be done from anywhere in the world (most of the correspondences is electronic now anyway).

Tell your fiance she needs to get her long form birth certificate (the one with her parents' names listed) as soon as she can. She'll also need to get a police certificate which she could get at any time - note that Montreal will only accept it for up to 1 year after it is issued.

Begin by reading the guides so you can send the petition right after you marry in May
