Hi guys!

My (ex) fiance have been cheating on me and has a 2-month year old son with another woman (!!!!) and somehow he decided one day that he was not gonna speak to me again and going to move in with the woman he has hated and talked bad about for years (he cheated on me with this same woman before) and he changed his number and everything and I've tired to reach him at work but he seems to be taking days off all the time.

He said he sent our petition in mid Jan, but I was concerened that we never got a NOA1 and after a month I was very worried but it seems pretty obvious to me that he never sent the petition to begin with since we didnt get a NOA1 and he kept on making excuses for why he haven't called the VSC, but lets say he did send it, then how can I withdraw it? My phone don't allow me to call to 1-800 numbers so I can't call VSC personally and I doubt they will look for out peition if I send them an e-mail. Can this petition (if sent and approved later on) affect my Visa Waiver-program that my country is a part of? I don't want to have to go trough the embassy to file for a simple tourist visa and would like to know if the petition was sent and then how to cancel it. I doubt I'll have any meaningful conversation with the idiot anytime soon, so please if anyone know how I can find out myself, please post your advice!

I'm sorry for your trouble. Have you or have you not received NOA1. Your signature says you did. From what I understand, since the petition is filed by the USC, it will be withdrawn by the USC as well. You could write a letter/fax/email to USCIS and explain the situation if your ex-fiance, who sounds like a real piece of work, doesn't co-operate. Good luck.

86 his sorry #######!!!!!!!!!!!!! I feel your pain...It happened to me a long time ago............Just don't reply to anything you get from USCIS if you do not withdraw the petition.and it will go away since you only have a NOA-1....

i want to but i dont know how to since im the benificary! and beside i dont even have a NOA1! at least not to my knowledge!

You the beneficiary??..This makes a world of difference....Again just ignore anything you get such as packet 3 and so on and they will figure it out. You cannot withdraw a petition if you did not file it but you do not have to be forced to continue on with it..Relax have a glass of wine and put this behind you..We all make mistakes even when we are 100% sure we are not...Stay cool and you will not suffer any consecuences...

haha yeah, well i emailed him asking him to withdraw it. But i doubt he ever sent it in the first place, but i mean.. i dont want it to be a problem next time i want to travel to the US, because if i filed for a k-1 visa they'll think im trying to come to the USA to stay which i dont have any intentions of...

No i haven't recieved my NOA1, and he came with his thing about some agent to call him about the case (i've never heard them do this..) and i mean.. i dont think he did send the petitionl i think he was just after the money i put in for the fee. But anyway, I don't know how to try to withdraw a petition where i cant really cancel and how to ask them to cancel it if it haven't gone through their system..?

suggest you get a skype account, pay for skype phone service / access, and use skype to call the 800 number.

Hello everybody. The solution is simple, you have just only to write a letter to that center where you state clearly that you do not want to perform an petition for your fiance, and that is it. Anyway, if they cannot get back that petition, you send that letter to immigration, maybe to the office you are closer; Do not sign any paper from him, Do not show up to any interview!, you can put him back where right away, thanks and bye,

You cannot cancel a petition, only the US citizen can do that. It should have no effect on your visits. Just bring evidence you will return (in theory at least you ahould always do that) and be prepared to explain the situation. If submitted and approved the petition will die a natural death four months after approval unless you go to apply for a visa.

As Gary and Alla said, you can't do anything about the petition. If on the off chance he did file it, you would eventually receive a notice from the US Consulate in Sweden that they have an approved petition for you and they will invite you to apply for a K-1 visa. You can choose either to ignore the letter from them and the petition will expire in 4 months, or send a letter back stating that you have no intentions of filing for the K-1 with this petitioner and ask them to close your file.

It sounds like you are probably safe, though, and that he didn't file the petition. You can certainly proceed as if he didn't. It should not have any impact on your visiting the US now or in the future nor using the VWP. Carry with you proof of your ties to home the same as usual.

It is good that you found out what he is like now instead of after. I'm sorry, though, that he didn't turn out to be the man you thought he was. Good luck to you.
